She can apply for her SSN before getting married. It's usually easier that way.

She needs to apply for AOS and get either her EAD card or GC before she can work.

What is AOS, GC, and EAD?

Hello!

AOS: Adjustment of Status

GC: Green Card

I don't remember what EAD stands for, as I'm not going through that process.

Hope this helps. :)

What are the requirements to get the EAD or work permit?

You can file for EAD and AP concurrently with the AOS and it will be free :) K-1 holders can file for those and no special requirements.

Hello Folks:

My fiance' is here on her k-1, and I am curious when she can start work.  When should she apply for her SSN after we get married or can she apply now before we get married?

Thanks,

Chris

Its up to you. She can apply for SSN before or after you get married. The earlier the better.

Then apply for adjustment of status (AOS) together with EAD (employment authorization document or work permit) and AP (advance parole - so she could travel outside the country).

Ok, about the EAD or work permit.  If she gets her work permit before marriage on a K-1, will USCIS frown on this before marriage?  Does this show them she is more interested in working than in marriage?  Don't we need to get married to get AOS, since our status is being changed from fiance to married after marriage?  Hence AOS is after marriage, and then consequently so is EAD?

Your fiancée applies for AOS, EAD and AP together after you got married. Wait until you have your certified marriage certificate. You need to submit a copy of it with the AOS application.

www.uscis.gov and then search for AOS,EAD and AP.

It's $1,225 for all three applications including the $85 Biometrics fee.

You can find pre-filled out applications here on this website (Guides-> Immigration guides -> AOS based on K1 visa; that will help you a lot with how to fill out the applications correctly)

Your fiancée is NOT ALLOWED to work until she has either her EAD or her Green Card.

As of right now it takes between 3 to 4 months for the EAD and AP combo card to arrive and anywhere between 7 to 12 months for the Green Card to arrive in the mail.

First you apply for SSN, the earlier the better. And definitely before marriage. Don't forget to go back and have the name changed on the SSC in case she changes her name when you get married.

Then you go get your marriage license.

Then you get married (before the i-94 expires).

Then you go get the marriage certificate.

Then you file for AOS (adjustment of status, a.k.a conditional greencard). With the AOS application you can also file for EAD and AP so she can work and travel while waiting for the greencard. It will take around 100 days to receive EAD and AP. The AOS can take up to a year.

If she applies for it before it will cost money (I don't know how much) and it will be expired with her I-94. It will take 3 -4 months to come in. The I-94 expires in 90 days from her entry. So no point getting it now

Get married and apply for AOS.
