Anyone else filed a petition for beneficiary before? HELP! Please

Hi everyone,

 

So my wife (from Argentina) and I are working on getting her CR-1 visa to bring her to the USA.

We already had our K1 visa and got married while she was, but unfortunately due to a family emergency, she had to leave the country and did not have Advancement of Parole, so she can no longer enter the USA until she has another visa which is why we're applying for the CR-1 now.

 

Now my question is,

 

#10 on page 5 of form I-130 asks "Has anyone else ever filed a petition for the beneficiary?"

 

Should I say yes, since I have filed before?

Or no, since no one ELSE has ever filed for her before?

It is not a trick question.  As you are the only one who has filed a petition, we assume..... the answer is "no", as you are not "anyone else"

You may be petitioning the beneficiary for a second time, but since it's only you then NO.

The general advice is to interpret the questions literally. As such, "no" should be correct (assuming nobody else has filed for her before).

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received
