Hey all this may seem like a silly question but here it goes: I am filing a I130 for my husband. We know each other since 2013 and got married July 2016 and in April 2016 I have birth to our twins. So the question is does having children with someone rule out all doubt for the person who will be interviewing us? Will they see oh they have kids so of course it's a bona-fide marriage and no further questions asked? Does anyone have experience with this? Thank you all

I agree with above. Having kids doesn't show a bona fide marriage - anybody can have (and care for) children without being in an active relationship.

congratulations on your twins :) such a blessing :) anyway, they still need more proofs than having babies :)

Who knows if the children are yours ...... USCIS start at level 0 ..... someone in the past will have "borrowed a child" for interview purposes and children do not confirm bona-fide marriage.

 

USCIS may even think you got married for the children after you got pregnant and gave birth and it is part of the "deal" to get a Green Card.

 

USCIS tough, expect the worst and it will be easier.

Hi, My hubby and I met in 2009, got married in 2013 and when I filed my i-130 I was pregnant with our first child. I included a letter from the doctor, ultrasound scan and a screenshot of our Facebook "we're expecting" announcement.   She was born before I moved onto the NVC stage and I continued with including pictures of her and us together and so on.  However.... I also provided quite the list of other evidence.  Having children together does not replace the need for all the other evidence unfortunately. Let me know if you want a list of what i provided

Wow! Thank you for your answer. I had no idea I am truly shocked that someone would borrow a child. And part of a deal for a green card even more sad! You made me a little worried. If anything I can provide them with dna evidence that my twins are his kids. Would that help?

Thank you so much for your answer! :) it would be so helpful to me if you provided me the list of what you provided to USCIS as evidence . I am feeling lost. I would appreciate  your help thanks.

here's a list taken from the guides. Birth certificate of kids born to you is just one of the elements listed. I'd definitely take the 'or' as an 'and', unless it doesn't apply to you (for example, you own a house together so you have 1 but not 2).

 

Note: Evidence of a bona fide Marriage 
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bona fide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financial resources; or
4. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
6. Any other relevant documentation to establish that there is an ongoing marital union.

Thank you so much! We don't have any joint accounts or any kind of joint Financial things :( all I can get are affidavits of people that know us that we have a real relationship. I am kinda of worried now.
