Well, the optimal solution would be to try to hold on to the current job at least until the visa is issued. For AOS, a joint sponsor and/or assets are definitely available. If that's not possible, then I would suggest proceeding with the process normally while he tries to find another job (and provide assets with the I-134 in case it will be accepted). If the CO still doesn't like that but is otherwise fine with issuing the K-1, then it will be put into AP pending a new I-134. As long as it doesn't expire (and you can request that they keep it active), it will just sit in AP until he can prove that he meets the financial support requirements. Once they get a new I-134, they can review it and then issue the visa (assuming it's good). It'll delay the process, but it's better than a denial and having to refile.

Thanks a ton Geo!!

Yes i told him the safe for now , to keep the current for a while nore atleast till we hit safe ground. He's had this job fr more than 5 yrs but then i dnt wanna base anything on hope eap wid everything being so uncertain about these visa processes...

Thanks so much all who chimed in!!!! :)

I'm not sure how the US Embassy works in Singapore but getting our NVC case number shaved off about a couple of weeks from the process. Basically in Manila, once you have your NVC case number you can pay the visa fees and schedule your interview even if the case is still "In transit" to the USEM. You just have to make sure that the USEM has your case at the day of your interview. I hear that in some countries, the ceac status needs to be "Ready" before you can even schedule an interview, which takes about a week or 2 from the time NVC receives your case.

Thank you!! Totally makes sense.

But we are in Poland, not Singapore :)

I'm curious, what's the difference between tax transcripts vs taxreturns vs w2 ? I'm only asking cause my  fiance is planning to use the w2 as am attachment of the affidavit of support.

Which is the one we should use?

Which is the one we should use?

Tax transcripts are the official IRS record of what was received and was processed. Tax returns are what you submit to the IRS. There's no way for a third party (i.e. USCIS or COs) to verify that a tax return you give them was actually submitted to or accepted by the IRS. It could just be a filled-out form that you never actually sent. A tax transcript has an extra aura of validity since it's a record from a government agency. W2s are what you get at the end of the year from an employer that states what you made, what taxes were withheld from your pay, etc.

For the I-134, the minimum documentation is noted here:

https://www.uscis.gov/sites/default/files/files/form/i-134instr.pdf (Page 3)

http://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter5-17.html

As for which one to submit, the tax transcripts are preferred. There's no harm in including the W2s with them as well. Sending the last 3 years is ideal, but only the past year's transcript (2015) is technically required. You may use the 2016 transcript if it was submitted already, albeit I think there's a several week lag time from initial filing to first availability, so 2016 transcripts may not be available yet for most people. If you can't get the transcripts in time, then you can use the returns but be sure to include the W2s and any other relevant documents supporting it (i.e. you don't want them to question if it is accurate or not). COs aren't tax professionals so don't expect them to comb through returns or transcripts, but they know how to look at the basics to determine your financial capability.

I got my tax return transcripts online. I printed out 2014, 2015 and 2016 and sent it along with I-134 to my fiancée in the Philippines.

Does anyone know whether an I-134 affidavid of support is required for every K-1 beneficiary interview?  Or only for embassys in some countries?

Not all consulates require the USC to provide an I-134 affidavit of support, but all consulates will require some evidence that the beneficiary will not go on welfare or other government financial assistance while in the U.S. You might want to contact the consulate in your country what their requirement is.

Hi everyone, maybe someone can answer this. My fiance and I will be coming to the U.S together once approved. Are we able to stop in a different country and vacation there, then fly over to the U.S? I am not sure how strict the guidelines for a K1 visa are. I do however know that once he enters, he is not allowed to exit and come back in until he gets his green card.

Thanks in advance.

Hi, I don't see reason why not, couple weeks long layover in Paris maybe :)? Hell yeah!

But personally I would not risk it. What if there is an unforeseen delay in the layover country? My suggestion is to get the US papers,  then travel anywhere you want.

Question to those who already have their NVC case numbers. Can I schedule my medical check-up even though I have not received my letter of interview? I do have the case number with me. Thanks in advance!

Hi @biggiehuggie,

As for the info I have got from couples who've gone through the same process here in Singapore. They don't just accept appointment not unless you already have an interview date with the US consulate Singapore.

If you really want to know yourself you may ring them and ask.

I haven't done it yet.. Just waiting for the letter from the embassy. Have to wait for it anyway for the COC (Police clearance singapore, Same thing - you cannot make any appointment without the letter from embassy - but then again you may call them) I don't see much difference with the timing so May as well save my energy and wait for the Letter lol.

Hope this helps.

No, not all of them require it. Or, more specifically, not all COs require it. Manila COs have not been requesting them very often recently (last couple years). You should still have one ready to go in case they ask, but it's possible they will not ask for it. The I-134 is not legally binding, so it doesn't have a whole lot of meaning to many COs in certain countries. The I-864 is the one where it gets serious because it is legally binding.
