Hello everyone!

My name is Diana and I just found this amazing site. I've been reading nonstop, and it's helping me a lot.

I am an independent tattoo artist/artist and love traveling, so I moved to Austin in February this year following a nasty divorce, made friends, and had a great time. While being there I met Randall online. Things just happened, and after a little over two months of dating we moved in together for a little bit. My time in the US was up, so I came back to Mexico and started working. He visited me in my hometown and met my parents in September, and after just a little less than five months of dating, he proposed. I said yes! I know it's fast, but they say, when you know, you know. I've never been more in love and sure about someone in my life.

But things turned sour when I tried to re enter this October and was denied entry by CBP. Then I realized I was foolish and overstayed for a few days on my last trip, and from what I've read, I also didn't wait long enough to come back. (less than 3 months) but things got weird, because the airline said that my VISA got cancelled, but it wasn't taken away from me/torn apart, nothing was written on it, no one explained or mentioned that it got cancelled. two weeks later, I have yet to find out if I was just denied entry, or I have to re apply for a new tourist VISA.

Currently I have an appointment at a CAS (the process we have to follow before the interview at a consulate if required) to find out my current VISA status and if needed apply for a new one, I'm bringing as many documents as I can to prove my ties in Mexico, the money, a job offer, and anything I could think of. I don't know if I should disclose that I have a fiancé before starting any paperwork, it seems that it would just be shooting myself in the foot again. So I don't have plans to (try to) return to the US until I talk to a lawyer and we decide what's next. I've read that getting married on a tourist VISA could have serious consequences. at this point we don't want to risk anything else.

In the mean time, my sweet loving fiancé is traveling 8 and a half hours by bus and i'm taking a plane, so we can meet close to the border in Monterrey and spend a weekend together. We don't know what's to come, but we just have to be together at least for a little bit.

Sorry for the rant and long post! I needed to get all of that off my chest.

➺ 02/08/17 Case Assigned to USCIS Nebraska, sigh. 

➺ 02/13/17 We got our NOA1! PD: February 8th 

➺ 12/15/17 NOA2 finally! after 10 1/2 months. 

➺ 12/21/17 NVC confirmed they received our file 

➺ 01/22/18 Documents sent to Rapidvisa 

➺ 02/05/18  NVC received our package 

➺ 03/15/18 Case complete! 

➺ 06/27/18  We got our Interview date! August 28th 

➺ 08/30/18 The package arrived (waited at Juarez)

➺ 08/31/18 Entered the U.S with my husband 

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

Definately take your time to read through the guides and familiarize yourself with the differences between the visas, whether you and your SO decided to go K-1 or CR-1 route. :guides:

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Be truthful in your answers, in forms and in person. Don't refer to your fiancé as a friend, it can get you in trouble if you're looking into moving here in the future.

The overstay, as it was minimal, probably won't delay plans to be together that much.
