You are earning $24,000 a year and have full custody of one of the children?

Then, you need to be claiming that child on your taxes and tell the other parent to stop. Roughly, you might be eligible for 3000 back a year between EITC and CTC.

It worries me that you aren't on top of the tax situation and are interested in a man from a country that is not on the same economic level as your own. Can I take a guess that he is younger? Maybe very eager to communicate initially? Men from the developing world target single mothers as easy prey for visa fraud because they know that single mothers have a rough time with dating and attention from a younger or more attractive man is flattering.

Please think about these things.

I don't know how I even got on this thread but I'm confused, I see all the issues here. Indeed....,However, it's highly unlikely with that low amount of income, she would any owe taxes, she's more likely due a refund. Next, she said her kid's father, not her husband so that is not an issue, in regard to a K-1. Also, when did being a single mom make you more scrutinized during the process. Further, she would not be a household of 3, if the other child lives with the father and he claims that child on his taxes, she has a household of 2 and the guidelines would apply to that.

She has been talking to the man for four months, what would be wrong with her planning a safe trip and putting the necessary precautions in place to ensure her safety and have a visit to meet him in person? That's how relationship develop. People can be so demeaning, rude and judgmental when no one person on the face of this planet is perfect and lives in a glass house.

She is an adult, and last I checked most people if not all, on this thread in the K-1 Forum, has a fiancé or is dating someone from a Country outside the US. How that came to be differs, however we are all still riding the same wave. Period.

It isn't more scrutiny but as a single mother myself at one time, I can tell you that I got harassed constantly on the pen pal site I met my husband by foreign men from the developing world. I had to block off whole continents to not get a multitude of messages each day. Even whilst dating in America, a single mother or father must be wary of child predators as well who do prey on single parents. An abundance of caution is advisable for single parents, this is not debatable.

Further, she would not be a household of 3, if the other child lives with the father and he claims that child on his taxes, she has a household of 2 and the guidelines would apply to that.

Yes, she would still be a household of 3 for I-864 purposes unless her parental rights were legally terminated. Please read the instructions of the I-864.

Part 5. Sponsor’s Household Size

Add together the number of persons for whom you are financially responsible. Some of these persons may not be residing with you.

Item Number 4. Enter the number of unmarried children you have who are under 21 years of age, even if you do not have legal custody of these children. You may exclude any unmarried children under 21 years of age, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your Federal income tax returns.

So, to clarify the instructions for you, you can choose not to count a child over the age of majority, usually 18, who you do not claim on your taxes. You may not exclude a child under 18.

Part 5. Sponsors Household Size

Thank you for the clarification as far as what the Sponser requirements are. Additionally my post was to say that there will be no more scrutiny for a single mom than there would be for anyone else. And yes an abundance of caution should be used when dating period, whether you have children or not. I believe this website is intended for, a safe place to post, express and ask questions. You clearly made you point, provided assistance and was not rude, demeaning or judgmental. It's posts like the ones that I have read on here that make people leave or not actively participate in the forums, it certainly appeared that she was being mocked and bullied, and that is my opinion. Thank you for the information and clarification, I certainly appreciate that and I'm sure the OP does as well.

The way that you type sounds more like you are the beneficiary, am I wrong?

Regardless, situation is unchanged, please read the earlier responses about income requirements.

It is fraud to not report the new job to the agency issuing food stamps. I'm not sure that you meant to type that the new job was not reported, but that is what it reads like.

I suggest you stop defrauding the government and get off the food stamps if you currently have an income over what you are allowed to make.

Your last post about paying taxes, him having Aussie residency in 3 years, being on food stamps, making over $30.000 and over and not filing

taxes sounds like a train wreck. I can not make heads or tails out of your post, you are all over the place with your thoughts.

Get your own life in order before you bring someone over here, save some money because he can not work on K1 when (if) he comes here.

Adjusting his status will cost $1070 after you marry here and then it takes about 3 months to receive his work authorization.
How will you pay that and how will you manage if he can't work ?
Sponsoring an immigrant is expensive, takes a long time and is no cake walk, especially for someone on food stamps.

File you back taxes. You can't have your cake and eat it too in regards to your income and food stamps.

Either make less and stay on food stamps and have a joint sponsor or make more and get off food stamps and have enough to be the sponsor.

You sound like you want it both ways.

Does it matter? OP seems pretty set on getting over to America regardless of the family consequences for himself or his "love interest".

And yes, I stand by the assertion that Americans do not speak/type like that.
