Entered on K-1, Now I Think I Want a Divorce

So I moved to the US in March on a K-1 visa and we got married a couple days later. I do have my green card now.

He is an alcoholic and addicted to painkillers. My life is miserable. I have not 100% committed to leaving him, yet...

But my question is, am I able to file for divorce from my home country? I would go back to Canada, and not stay here. I am wondering if it is possible to divorce from Canada, because I do not want to stay here if we split, and it would mean us having to live in separate residences in Arkansas for at least a month before I could file for divorce. I can't really afford to move out/live alone here, nor do I have a car, so I am currently walking to work and the only other place in walking distance is considered shady: lots of police, there's been rapes, drug deals, regular tire slashing, gas siphoning, etc, so I obviously do not want to live there for a month and then during divorce proceedings, especially since I have to walk while it is dark out.

Yes you can divorce from Canada. The only thing I want to warn you about is that the waiting period in Ontario is 1 year of separation.

If you want it done fast try and find a way to stay in Arkansas. If I had room I would let you stay with me, I'm also in Arkansas. So sorry you're going through this,

That's just awful, gosh. My sympathies. I personally would go on and go on back to Canada and file. The year will go by and it'll be over eventually, but you won't have to be near him and you can go be with people that care for you. Good luck.

Yes!! Go back to canada and be safe!! This man sounds like a liability and you don't need that negative energy in your life. There's no shame in divorce. Always do what makes you happy you only get one life!!!

I've been in a similar situation (disturbed marriage in a foreign country), if it's that bad you just need to distance yourself immediately and get back to near people who love and care about you. If that means going back to Canada, then it'll be the better choice. The people on this forum can help you with any questions regarding the visa/paperwork side. Don't be afraid to ask, there are a lot of helpful people here...especially if you feel alone and like you have no where to turn.

I know it can feel like starting over from zero and you can feel bad about making the wrong decision, but moving on is the only thing, be safe, be near people who care. That's the important thing.

It's much cheaper and faster to divorce in the USA than it is in Canada. This does depend on state, but for instance when I have driven around Oklahoma city, I see signs everywhere for $250 divorces. That wouldn't even cover the cost of a signed piece of paper in Canada.

But it's better for you to be safe than to be there, so go to Canada!

It's much cheaper and faster to divorce in the USA than it is in Canada. This does depend on state, but for instance when I have driven around Oklahoma city, I see signs everywhere for $250 divorces. That wouldn't even cover the cost of a signed piece of paper in Canada.

But it's better for you to be safe than to be there, so go to Canada!

I wouldn't be against divorcing here, but my state requires us to live separately for at least 30 days first, and that just isn't doable

Have you done AOS yet and are free to travel? Members, is it possible that could she file here in the US, and then spend the 30 days living with relatives or something in Canada, and come back for the divorce to be finalized?

If you only need a month in the states, try looking up a room on airbnb. Hopefully you can afford something on there near your job. Good Luck
