Which tourist visa option will give me a better chance?

My previous tourist visa I used extensively (about 7 times in one year) for short trips one week to the longest being four weeks was cancelled as it got damaged. Every entry the information I gave was exactly the truth - work reported as that and personal as that. Even the one for the wedding I informed accordingly - was always let through and I always left as per my original flight booking.

Visa was cancelled due to damage and new one was refused and that stage hubby was looking at moving to Dubai to join me as we had started another new business apart from the ones we have. However, due to my B1/B2 cancellations I was unable to pursue that business as my travelling to the US for sourcing was mandatory for that. Fashion related and I had to be there. We lost a lot of money and now we have decided that I will move to the US. Still pursuing existing business and will sell it once my visa comes through.

I would like to visit the US a couple of times before my I-130 is done:

1. I have lost the connection with step kids and its become upsetting as they are fast growing up... they won't come on Skype for more than 1 min

2. My parents in-law are not keeping well and deteriorating...

3. Want to be with hubby for his birthday/ Christmas New Year

When I was denied B1/B2 replacement - we had no intention of wrapping up where I am and had then just invested even more in now sunk costs

Since that application was denied we have filed for I-130 about 3 months later and hopefully will get NoA2 soon

I know no one can predict how a new application will go but.... I have two options. A New European passport is in process for me. Is it better I wait for that and take a chance with visa on arrival (of course will declare all past arrivals and one rejection) or just apply again on current Indian passport.

I know I have a higher risk being sent back when I go for the visa on arrival route - but I really want to take a chance to see the kids/inlaws and although hubby flies here to see me - I always want to see him.

Which is a better option? New B1/B2 application or wait for European passport.

I don't think it matters which passport you use.

Because you're still you. Even with a different passport.

With European passport I assume I don't need to apply for visa in advance...

If with the "visa on arrival" you mean ESTA/ the Visa Waiver Program, you would need to declare the rejection when you fill in the online form, and you would almost certainly be rejected for the VWP then. There is nothing wrong with trying again for a B2 tourist visa, but your chances of getting one are small. Still, if you have the money, worth a try.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you all. Will apply again anyway and take a chance - I don't think it negatively will affect my I-130 even if rejected as I just want to see family.

Terrible question and I don't want to type it even but I always fear if something tragic were to happen like one of my in-laws passing or getting to the last stage - are there chances that they grant tourist visa in those circumstances at least. My husband is close to his parents and I know he will be broken and he will need me...

Selling/buying citizenship?!?! Which previous post do you remember the one's where I reported posts of some citizenship selling to admin??

To clarify, you don't get visas on arrival in the US (except for Canadians). You'd have to apply for ESTA with your new VWP passport, and you'd probably get denied before ever setting foot in the US.

This was already clarified before by others. My denial I guess is not as sure shot as you make it - some one else was more to the point saying its up to the visa office.

You cannot have an Indian passport and a foreign one; hope you realize you have to renounce Indian citizenship when you acquire a European one.

Yes am aware - hence never took the European one even though my father has it. Got papers together to apply now and will get it in a month if I do - but don't want any more delay in my I-130 because of change nationality.

Given it won't really help me visit either. I will just apply for B1/B2 again - given changed circumstances when last applied and hope.

Will bother with the European one only after my green card perhaps - if not too complex.
