Bringing Elderly Parent over by Green Card Holder

My husband is a Conditional Permanent Resident from Canada. He came over here on a Fiance Visa.

His mother just died back in Canada and his father is suffering severe back pain and grief, and is currently hospitalized.
We'd like to bring him to live with/near us in the United States.

From what I've been reading, my husband can't sponsor him until he's a citizen, but this Humanitarian Parole seems to be an option.

I'm hoping that we can bring him over using that. Also, you may not need a Parole for him to just come and visit us, but that wouldn't cover medical expenses.

I'd appreciate any advice on how best to proceed. Some of the current concerns:

1. Humanitarian Parole best option? As a daughter-in-law, I don't think I can sponsor him, although I am a citizen.

2. Transferring his CPP and AOS to a USA pension plan. Looks like there is an agreement between Canada and US, but not sure how to transfer it.

3. Health care down here. Looks like there is an option under Obamacare now.

Any advice?

1. Not an option.

2. No idea, have a look in the Canada forum, I assume he would have it paid normally and transfer funds when needed.

3. Depends on his age but likely OCare, after 5 years as a GC holder he can buy into Medicare.

My husband won't be able to get citizenship for a while.

I'd hate to wait that long as his father is pushing 80 and might not last that long.

A 6 month visa would be a good idea, if he were in better shape himself, but I don't know we could provide the medical assistance and pills he needs without him actually immigrating.
Although Immigrating seems like a waste of time at his age and in his shape.

Anyone have any better ideas?

There is no 6-month visa. He can visit for up to 6 months at a time without a visa.

Hi,

Unfortunately, there is no quick path for your FIL to immigrate to the US.

His son must be a US citizen in order for him to immigrate to the US.

A Canadian can visit visa-free fro 6 months to the US.

If your FIL comes as a visitor, make sure he has travel insurance and he can get his medications through the Canadian health system. If your FIL use our hospitals without insurance and can't pay out of pocket, he is unlikely to be allow back to visit.

Does anyone have any better ideas of how to bring him here now and have him cared for properly here? I outlined the situation above. If humanitarian parole won't work, any suggestions on what will?

If this was possible, there would be plenty of LPRs who would like their elderly parents to live here.

The FIL coming to the US isn't the problem as he can visit. It is the medical coverage while here that may be the biggest hurdle.

He can apply, but he is not going to get a visitor visa to come and de facto live in the US.

What you want can not happen. You can't seem to accept this.

The only idea that would work is for your husband and you to go and live in Canada. I'm being serious. Not messing with you. Trying to help you understand things.

I am not sure what you are asking here. He can visit without a visa for 6 months. He cannot use his Canadian status to try to live in the US. Your husband can visit him in Canada or wait for citizenship and then apply for him as stated by multiple people. There is no quick way to get him to immigrate despite the death in the family and his age.

Timeline

He can VISIT for up to 6 months, but he cannot abuse that privilege to live here. Period. Your husband cannot petition for him until he becomes a citizen. Period. If he is here and uses the US healthcare system while visiting he must be able to pay out of pocket or have travelers insurance that will cover it. Period. If he uses our healthcare system and cannot pay he will not be allowed back into the country until he has paid off his healthcare debts. Period. Immigration to the US is not easy and a death in the family or health issues are not humanitarian reasons. Everyone has deaths in the family and many have relatives with health issues. Think about it, if our government allowed every relative who has health issues or have suffered the loss of a family member to immigrate think of the millions of people who would be allowed to immigrate just because.
