Yes there will be a problem, though less so after two years than if you tried now.

And to be clear on the waiver- you are elligible to FILE one; that does not mean it will be approved, it just means you can ask for it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It's not just a waiver you need to apply for...you do need a waiver of the 5 year ban. But, all that does is give you the ability to apply for a new F1 visa. During the visa interview, you will have

The marriage is not now. It is after 2 years. I am eligible for waivers as they have given me some papers and it is written in that. The only thing I want to know is will there be any problem filing the petition after 2 years or so?

Is it odd a USC parent would fix a daughter's marriage to a previously deported and currently banned groom? Doesn't pass the smell test..

One more thing is , my parents have fixed my marriage to a us citizen who will be coming to my place to get the marriage done. Can she apply for me even if I'm in deported case?

Unless she is the one moving?

I think after 2 years you have a better chance BUT to prove the marriage is real she should visit you often.

I-212 is what you'll have to file, read up on it.

Visit immigrate2us.net they deal with complicated immigration issues like waivers.

She is perusing her doctor degree there . And yes she will be visiting my country for the marriage. She just can't leave her studies and sit my country. ! Thanks everyone, really appreciate it.

Maybe forget trying to "get back to America" for the time being.. and work on the outstanding issues first?
