Boss has fraudulent work visa

Hi all, this is my first post as I am a US citizen by birth so I never dealt with immigration before. I was hoping to get insights and guidance from you all with a situation I am facing. Basically, we have a manager that got moved from Canada to our US office 10 months. He is not exactly a nice person. 2 people have already voiced concerns over him and I have too as I feel he has it in for me (never though I'd ever use that phrase in my life as I am usually really easy going lol).

Before he came along, my work was stellar and my yearly reviews were as well. I was given a poor review by him and it looks like if he doesn't feel I improve, I will be let go within 30 days. The problem is, his requests are not doable (deadlines impossible to meet, unless you don't do this little thing called sleeping).

Now this is where it gets somewhat interesting. He did not qualify for a work visa on his own merits, or rather, the position he was transferred to, does not qualify for a visa (TN I believe?) So basically, the company straight up lied and made up a fake application (fake job title etc) so he could get the visa. I know this because he is not too bright and told 3 people whom he felt he could trust. Sad thing for him is, these people are close friends of mine. I also overheard him talk about how his spouse was going to be traveling outside the US and he was worried that she would not have her ducks in row when questioned by CBP on the way out (since his visa was obtained fraudulently).

I was always bothered by the fact that he is absolutely stealing a great job from an American worker but I thought, it's not my place to say something. Now that I am being bullied and will most likely be forced out of my job unless he leaves, it seems that it's either him or me lol And last time I checked, I was in this country first lol I mean that light heartedly because I do enjoy the richness the (LEGAL) immigration population brings to our wonderful nation.

I do know chances are, ICE wont deport him but you never know. We do work for a huge household name company and it would be a big deal if news got out.

My only thought on this post is this site is to help people that want to come to the US legally. It is not for helping people deport others. I am sure there is another website that would be more helpful. But this is not it.

Timeline

You must supply evidence of your fraudulent immigration claims to ICE, not just place an anonymous call.

Perhaps you should approach your HR department to help work things out. That would be the professional way to address the issue.

Timeline

There is data at the footer of the page about how to report immigration irregularities. You will need as much hard documentation as you can because a lot of people that don't like their spouse/boss/the guy next door try to use immigration to get rid of the problem so with no hard proof you aren't going to get anywhere with immigration. Also don't expect them to tell you what has happened once you report it.

This will not be over quickly. You will not enjoy this.

Are you certain that he did not come via an intra company transfer visa or L visa?

Thank you all for your replies. No, I am not disgruntled as I love my job and company but yes, I am unhappy with the way this person is handling things and at the fact tbat he is in the US under false pretenses and should not even be here at all lol

I do have evidence that this is visa is TN. Not the L type.

In any case, thank you for the link to ICE, I will contact them. I doubt if it will do any good, but again, he cannot hurt, either.

How can you make such accusation without concrete proof, don't talk yourself out

of the stellar job, I know at times one can get some mean spirited evil person to work

with , but that's your company you are ready to take down, maybe one visa app, did

not work & they tried another, he came legally , and if you are getting down to his

level I say look for a new job & forget that place.

Finally its 2 sides to every story, some ppl hate changes & anyone that comes along

with it, maybe he thinks you do not apply yourself, could jealousy be in play, Xenophobbia

because he's a foreigner with the position....introspection dude hope you get past this.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
