Hello guys,

My sister (american citizen) is submitting a petition to bring my mother but my sister has not lived in the US for 4 years. We submitted the I 864 forms (affidavit of support) but they told us that my sister needs to send proof of residence and a letter explaining why she did not fill out taxes for the past years. A couple of questions:

1. Does an american citizen can still submit a petition to bring their parents even though they don't live currently in the US?

2. Is my sister required to fill taxes if she hasn't work in the US - since she was working and living oversees?

3. Can any one help me with a tempalte letters explaining why she didnt fill out taxes for the past yeras?

Also American citizens and green card holders are required to file their taxes in the USA even if living abroad.

Why has she not filed taxes?

Why is she filing for her mother?

Hi boiler,

My sister was living oversees that is why she did not fill taxes? We are requesting a green card for my mother? We sent the I864 form. I am the sponsor. I have a green card.

If my sister didn't work abroad and she is back o the US now can she do it? So should I say this in the letter?

You sister must file on her world wide income , she can file the taxes now and pay what was owed and fines if any. She as the petitioner must be the one your mother is being reunited with for the visa to be approved. It doesn't matter that you are in the US ( other than you can be the joint sponsor )

This will not be over quickly. You will not enjoy this.

Sister it seems os now back in the US so it would be for reunification.

No you can't just say your sister is living in the USA when she's not. That's misrepresentation and can lead to a lifetime ban for your mother. Don't be silly.

If your sister is not living in the USA your mother will have to wait for you to become a citizen or your sister to be living in the USA for her to immigrate to the USA.

Sister should read through the I-864 form and instructions. If she did not earn enough (anywhere in the world) that would require filing taxes then she should submit a signed letter along with the I-864 explaining why.

Also sister needs to establish US domicile or give evidence of intent to establish domicile.

The thing with citizenship or any association responsibility is that, you pay your dues so that you can utilize the benefits of the "membership" when you need it.

Filing Taxes is a citizenship's obligation to the country.

Your sister needs to file her taxes for at least the past 3 years.

Then she can look into meeting her residency obligation.

You can't just obtain citizenship and ignore all obligations and send people over here with those privileges she hasn't kept her end of.

As a USC, your sister is required to file taxes on her worldwide income, adjusting for local taxes, unless she did not make enough.

Adjustment of Status from H-1B, Family-Based
07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.

07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.

The foreign earned income exclusion was $97,600 for 2013, $99,200 for 2014 and $100,800 for 2015. If she qualifies for the exclusion and made less then that then she would owe no back taxes I believe.
