So put in consideration I will only need to go back to my own country again in 10 months (Christmas Hollidays), there is a reason for me to take the AP? am I missing something?

For what I understand I arrive to the US, take the SSN after 2 weeks of arriving and after I get married I should take care of the AOS and EAD, but if changing my AOS to "Conditional Permanent Resident" *will make me free to travel outside US for short period of time* there is any real reason to take the AP unless I wanna travel outside the US before I have my new AOS?

How long it will take from sending all the paperwork for AOS until get the green card?
(Just trying to avoid more paper work and maybe even pay for more stuff...)

*Section 6.0....AFTER MARRIAGE - ADJUSTMENT OF STATUS*

As a Conditional Permanent Resident, you do not need advance parole to reenter the US after traveling abroad. The I-551 stamp (if you got it) or green card is also proof of authorization to work.

There have been many posts on here from people that did not apply for AP, and then had an emergency back in their home country and needed to travel urgently. Some people had to wait more than 10 months to recieve their green card. It is free when you apply for AOS, so it really makes no sense not to apply for it.

It took us about 6 months to get the greencard from the moment we filed AOS documents. But our case was very rare because we did not have an interview. However, we knew that we would need to travel to India in December 2015 and did not want to risk NOT having the green card so we applied for AP at the same time when we filed the whole AOS package.

The question is why not? It does not cost extra when you submit your AOS package and it comes with your EAD (it's all one card). Getting AP is more like a "just in case" thing

Free?

Why not.

So why apply for AP?

The answer is simple:

  • It is free when filed with your AOS
  • It is fairly easy to include with your AOS application
  • You will have it just in case for emergency travel

It is better to have it and not need it, than need it and not have it.

I agree it's better to be safe than sorry. Even if you don't plan on travelling you never know what will happen. I had only been here 2-3 before my father was diagnosed with cancer and I had to rush back to Sweden.

  • 2 months later...

So I'm taking care of the AP but I end up with some questions, I'm just taking the AP just to play safe in case I need to go to my country but I have fields here like "Date of Intended Departure" or the part 7 "Complete Only If Applying for Advance Parole - how you quality for an AP Document"

How should I reply to those?

Write "unknown" in all spaces asking for specifics about reasons and dates. Those don't apply to you as you don't require any reasons whatsoever to be eligible for AP as an adjustment applicant.

You do not need to state a reason for travel or a destination country.

At the bottom of page of 2 it states this : If you are applying for a non-DACA related Advance Parole Document, skip to Part 7

An adjustment applicant does not fill out Part 4 stating a reason and purpose of their travels, and you do not need to supply the extra statement.

You can put Unknown for departure date and length, but you could also follow the instructions and put N/A for things that are not applicable.
