Letter of Intent to Marry RFE

if this is truly the intent....and yes I've reread the current instructions and they only mention "an original statement".....then if they were to go this route, I'd have that letter notarized (as a means to officially show it is their signature and not someone else's), email that to the petitioner and have them file that.

It has been a couple years now, and people are sending scanned letters of intent without getting any RFEs. If anyone is still getting an RFE for scanned copies, I have missed them. They seem to have to disappeared and are not an issue anymore.

You are correct and I was not. I looked at the VJ form, which is older, and not the current one on the USCIS website. It does only say a statement is required.

So I would hedge my bets and have the remote signature notarized as a means to validate it's origin and email that for submission.

I am asking a question for a friend. She has petitioned for her fiance through a lawyer who is not helpful and doesn't know what he is doing.

After 8 long months at TSC, she has received an RFE because the letter of intent to marry was not included in their original I-129F packet. I know it is supposed to be an original wet signature letter. Her lawyer is also insisting it be notorized. She asked me to see if there are any VJers out there who received an RFE for this letter of intent and if they sent in a scanned, unnotorized copy and got an approval?

I've explained to her what is supposed to be sent. Her RFE letter does not state that it must be an original or notorized. She read it to me and it simply says "a statement from the petitioner and beneficiary of intent to marry within 90 days of entering the USA". They would like to avoid the expense and drama of him seeking a notary and Fed Ex overnight fees. I think its a risk because I feel like extra scrutiny will be used since this letter has now been specifically requested. I know some VJers have stated they sent a copy in with their packet without a problem, but since this is an RFE, I would tend to be more cautious with what was sent in. Would they get another chance to send in an original if the photocopy was detected? Or just be outright denied?

We too used a lawyer. He was good and bad...:-( He forgot to put in the statement 'Marry within 90 days of US arrival'. We got an RFE. My fiance was 9,000 km away. So he just sent an email attesting to that effect + emailed a signed Word document to the fact which I printed out and sent in with the RFE. Wewere approved a month later.

Just as an aside, I was going to visit him again just before the RFE. The attorney took the opportunity to include these latest plans as well as more chat logs, thereby more front loading.

I can confirm that recent RFE's from the master list were for not including a letter of intent at all. None of the recent RFE's were for not having original signatures. People who recently responded on the master list I typed up sent Wet signatures to be safe, but I can confirm that no RECENT RFE's have been for non original signature.

On the current list the only wet signature requirement was for actual forms in the petition such as the petition itself and the biometrics forms for each the beneficiary and petitioner. Those forms MUST have wet signatures.

I told her she should consider it and that I'd help her if she needs it. Pretty much at the end now tho.

We had an RFE for the same reason (forgot to include beneficiaries letter of intent to the I-129F package). We just sent a scanned copy of letter of intent and it was sufficient, got approval without further RFEs.

We need both of us to have the letter of intend ?

The whole intent to marry thing is just ridiculous and archaic to begin with. It should just be something you sign as part of the petition form. Like signing a letter of intent is going to deter anyone who intends to commit immigration fraud.. lol

This thread was discussing using a scanned copy instead, and you can make color copies so blue ink doesn't really prove a signature is 'wet'. Back a few years ago when the original signature was definitely required, it would be suggested to sign on top of something soft, like a magazine, so that the indentation of signing with a pen would show.

Yes, we did the same mistake of including letter of intent from petitioner only with the original packet and got RFE for that. Definitely both letters are required

I hope it's just that, after the notification from application that notify u for RFE how long it took to the hard copy of RFE to be in mailbox at your fiancé ?

I don't remember exact amount of days but not long - about 2-3 days
