Hello guys, I have been using the resources on this website and it has helped me tremendously. I need someone to help me out here.

My wife came to the US from Pakistan in Dec 2013. She got a conditional Green Card that is set to expire on Dec 15, 2015. We filed the i751 and just got a letter in the mail that says she needs to have her biometrics done on November 26th.

Here is the problem- My wife is currently visiting her mom in Pakistan and she is not set to come back till December 22nd. I know I can re schedule the biometrics appointment, but would that mean her Green Card will no longer be valid after December 15th? Would she lose the Green Card and I would have to file all over again?

I'm very confused right now so please any advice helps.

Even if I re schedule the biometrics appointment, would she have to come back before Dec 15, 2015 in order to not have any problems at the airport immigration.. But at the same time wouldn't the Green Card expire on the 15th of December, making her a non residence in the US.

What if the re schedule date is after December 15th, would she be out of status until she gets her biometrics done?

Sorry for the confusing thread, thanks for all the help in advance.

Thanks!

Was she clear on the expiration date of her conditional Green Card? I'm curious as to why travel plans were made that would have her return be after the date of Green Card expiration? How long has she been out of the country?

Yes, we were told that once we file the i751 we will get a letter in the mail and her CC card would be extended for 1 year automatically. She has been out of the country since November 6th 2015.

But did she get the letter for one year extension; and does she have this letter in her possession?

The extension letter and her current Green Card will be needed for her to gain re-entry into USA.

Other than that critical situation, I see no problem if you can reschedule the biometric.

However, as I have mentioned in other threads . . . I am mystified how those in this critical situation can EVEN THINK about traveling outside USA, except for really big emergency situations. Just too much at stake.

The purpose of the receipt/extension letter is clearly stated on it, "During the one-year extension you are authorized employment and travel." Toward the bottom of the ASC biometrics letter is a section and instructions about rescheduling the biometrics appointment, follow the instructions. Fully realize that you are again at the mercy of the USCIS scheduling minions....who knows when the next appointment time will be? It may be wise to be done with the biometrics appointment as scheduled, then do what everyone does.....wait...... like watching paint dry...........

International travel with the I-751 receipt/extension letter and other appropriate documentation should be no cause for alarm, or a reason to cancel such travel. Check out this thread from earlier this year, and our #4 posting: http://www.visajourney.com/forums/topic/528601-travel-with-an-expire-residence/

YMMV,

Good luck on your immigration journey.

Good luck on your immigration journey.

On the letter that I received, it doesn't say anything about extensions.

This is what is says-

To process your application, the USCIS must capture your biometrics. Please appear at the below application support center at the date and time specified.

At the bottom of that letter (the one which instructs your wife to appear for Biometrics) there's a little bit of text pertaining to rescheduling the appointment.

Be prepared for the eternal waiting game. Be prepared for average news.
