Why do you keep posting the same question, your previous post with responses, informed you, that your husband needs to file the i130 petition for a spouse visa.

No more, to be done until it has been filed and approved. Please read the guidelines and proceed accordingly.

Sorry about the first sentence in my response, but all you can do now if file for a spouse petition. The embassy t the interview ill tell you if you need a waiver. No one can answer this but the embassy. You are stressing yourself out over things that can be over comes.

My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th
CC on both cases March 30


Current record holder of fastest through the NVC :D

Medical exam in Stockholm April 13th
Interview on May 16th !!!

POE Anchorage July 12th!! 2012

July 2015 n-400 in the mail

September 2015, interview

October 23rd 2015, Oath ceremony!!!!!​​

Agree.

You will not know about the waiver until the interview, say a year or so away, they could hit you with Misrepresentation, they certainly have cause to do so.

You cannot at this time come to the US.

You can:

1. Apply for a tourist visa which will probably be denied due to your prior overstay and having a USC spouse and child.

2. Have your spouse file a petition for the CR-1 visa.

There is not a coming to the US and doing the paperwork here visa. You could have done that prior to leaving but now you must wait outside the US until you are granted a visa. At this time no one knows if you will need a waiver or not.
