I was also wondering what she said on the F1 application, like no US love interest and then she is back there a few months later looking for a K1.

Hi, I have applied 129-F for my fiancee and today was her interview. She got denied in Georgia, Tbilisi basis on previous F1 visa denial. They gave her 221(g) for and checked Administrative processing. The main thing they talked to her about was her F1 Denial prior to 129-F petition. She got denied because they told her she knew she was engaged and applied to F1. Therefore you applied F1 visa in order to get marry with your fiancee. Could you help me what could be the next step?

I think the case is being scrutinized..its in AP I would talk to my congress-person

and have enough arguments & proof that getting married was talked about with no

set date ...just prove its bonafied, or going to get married is the next step, but

proof to respond to 221 G would still be required

The OP didn't say whether he was on the consular premises for this interview, but it appears that he was not. The petitioner's presence can head these things off at the pass. This case refutes the spate of cavalier, misinformed, reckless, outright dangerous "advice" that's been prevalent recently in these forums about "it doesn't matter if the petitioner isn't there" and similar poppycock.

Did you insist to speaking with the CO to find out what the problem is and offered to give them whatever they need to convince them of

your genuine relationship or did you just leave without saying anything ?

I just asked kindly if she is getting visa or not? CO responded that she is filling up information and it is under AP. We will receive result once it is gone through AP.. That is how we left, in deep cold sad mood... My fiancee was crying outside of the Embassy and I did not know what to do. It is really hard to go through such emotional situation..

Ohh, not quite what you posted, perhaps the Consulate is also confused about some issues?

This result seems to be s common trend for all visa applicants. If the CO is slightly unsure in anyway they have to put you under AP to do further investigation. I am not sure what they do exactly but they do some type of investigation. You can get your local congressman to call and help you out. It might help.,

I understand that you feel like a 2x4 hit you upside the head and yes it is hard to deal with a refusal.

We were in AP for 16 months and our case was returned to USCIS where it expired so we had to file another petition.

As of now you have not been denied, only refused and are under an investigative process.

You can be proactive and assertive with a senatorial request for a second interview and more evidence submission regarding

the F1 issue and if you are still there you can try to see if the section chief will see you and at least he will hear about you trying to

get a turn around in case they think about returning the case.

Omg I saw this post and it got me all freaked out. I applied for college last year when I was in Miami to actually just have a time out from home. I applied before I met my fiancé but we got engaged a month after I got the letter from college saying I'm in. I started to gather all documents so I could apply for F1 visa. We didn't know that there's a fiancé visa at this time and I really wanted to study before we get married. He was my bank sponsor and of course my F1 visa was denied. So we applied for K1 and hired a lawyer to make everything right. Our petition should arrive at the NVC soon but now I'm scared we will get denied too.
