Timeline

my brother get married a year ago his wife started filing for him but it turns out they got divorce for some reason before the filing complete.

he did get a work permit and his social security the only thing that was left to do is interview which he never get to attend since he thougth it

was cancel because of the divorce. now we find out that the case is still active. my question is there any way he could still go tru with this process?

What petition was filed? His process was based on marriage, but more info is needed to give correct answer. It sounds like AOS from K-1. If this is true and they were divorced before interview, and she canceled I-864, then NO he cannot adjust his GC and must return back to JA.

  • Seem like K1, he cant adjust even if he marry someone else

He should have talked it over with his divorce atty, who could

have delayed the process, a yr was short & she must have cancelled

the affidavit...His only hope would have been a U visa if she was an

abusive wife and he had reported it to the police.....he has to return home
