Hi All!

So my husband has his interview on 10/10/2014. However we won't fly back to the US until late November/ early December most likely after the interview date. My husband has to wrap up leaving his government job here in Morocco, sell items from our apartment and move in to my in laws pack etc before we leave.

Our anniversary is 3/8/13 and if we fly back in early December - we will no longer have time to file as USCIS in the instructions demands we file for removal of green card conditions 90 days BEFORE the second wedding anniversary and that means filing before December 8th 2014.

Advice, suggestions, tips??

Not sure as to a solution for this problem.

Husband goes to US Consulate to request an extension of his visa - US Consulate says they won't extend his visa however they can issue him a new one at the cost of 3000DH/ $311 -/+ and to come back the last week of the month to get his second visa- 3/08/2015

Husband returns to the US Consulate and picks up *NEW VISA* with expiration date of 09/22/2015 on: 03/26/2015

Husband's first visa expires: 04/08/2015

Protection Civile continues to pay my husband - 04/2015

The lawyer sends letters to the Ministry of the Interior - 04//2015

My husband seeks help from the Prime Minister of Morocco's political party and called the lawyer to set an appointment to check on his case: 05/6/2015

My husband seeks help from a second lawyer when the first one proves unhelpful: 05/07/2015

My husband goes to Parliment to follow up with the Prime Minister's party - set a follow up appointment at a cafe the next day: 05/08/2015

I send a letter to the Moroccan Ambassador to the United States asking for help with my husband's case (registered mail): 05/26/2015

I go to Sen. Diane Feinstein's office seeking help with my husband's demission from the Protection Civile: 05/27/2015

I go to Sen. Barbara Boxer's office seeking help with my husband's demission from the Protection Civile: 05/28/2015

My husband returns to hometown in Morocco and returned his materials, the message awaiting him says "Demission Favorable.": 06/11/2015

Lots of running around to meetings and trying to get the authorization to leave Morocco by my husband: 07/2015

Husband goes to CMN airport trying to get paperwork authorizing him to leave Morocco and with the help of some powerful people GETS THE AUTHORIZATION: 07/23/2015 :dancing:

My husband leaves Morocco and arrives in the U.S.A. and meets his daughter for the first time at SFO airport: 07/27/2015

Hi All!

90 days before your 2 year green card anniversary not wedding anniversary. When he receives and receives his green card the expiry date will be on it. So you arrive November you would be filing 21 months from that date.

Can I suggest why not arrive in US after your wedding anniversary. He will get a 10 year green card and no removal of conditions.

Thats a great suggestion. Only problem I am pregnant and the medical care here in Morocco is horrible where we live and we can't afford to commute every month to a larger city to see a OB/GYN. I really would prefer to give birth back in my state with my mom and in my home country the USA - where everyone speaks my language - English! I have heard to many horror stories of botched births here in Morocco from women I know personally or through a mutual friend to trust giving birth in Morocco with my husbands and I's first baby!

My husband agrees with me as he works as a fire fighter here and knows the state of the medical system is ok to crappy at best.

Thank you again for that suggestion - we would do if we weren't pregnant :)

Do you know if we can file to remove conditions early?? Like once my husband gets his green card?

Yep....that is exactly true. Your trying to "remove conditions" on a card that does not yet even exist.

Secondly there is no benefit to ROCing early, a green card is a green card.

Your husband have to pass the interview and receive the visa first. If everything goes well with the interview and he is no place on AP then he will have to arrive in the USA to be issued a greencard. The greencard will have an expiry date if he arrives before your second anniversary. Before the greencard expires, he should file a paperwork to renew it 3months ahead of time (90 days widow). Well, if he is place on AP you may have to move back yourself and wait it out due to your condition. Perhaps by the time the AP will be over and he's found eligible to receive the visa then he would have hit the two year mark to be eligible for 10yr greencard. If he's got the 10yr greencard, you will have nothing to do with removal of condition forever! Good luck!

He is being interviewed for CR1 visa in like 11 days, he DOESN'T have green card yet. Please read before contributing. OP is confused with 2 years anniversary of greencard and 2 years marriage.

Only solution is that you reschedule your spuose's interview after your 2 years marriage anniversary (3/8/2015) and if he passes the interview, he will get IR1 visa which allows him to get 10yrs GC once he gets to the US. I don't know about possibility of rescheduling the interview though.

That's not correct. The date that matters for CR-1 versus IR-1 is not the date of the interview but rather the date of POE. No need to reschedule an interview if the visa will last long enough to pick flights after the 2nd anniversary.

Your response is wrong, the interview letter will clearly state ir1 or cr1 based on length of marriage.

Sure, if a couple is already past the 2 yr mark at the date of the interview letter, it may be updated accordingly. The point, however, is that the receipt of the 2 year versus 10 year green card will be determined at POE.

My husband and I were not married for 2 years when he interviewed. Our 2 year anniversary occurred after his interview and before his entry on US soil, where his CR-1 visa (issued as such at the time of interview) was immediately converted to an IR-1 by the officer who processed his entry into the US, and he received a 10 year unconditional green card in the mail shortly after. I researched this and we did it ourselves. It's the point of entry, not the interview.
