Citizenship denial?

Im asking in behalf of my friend, she was seperated now from her husband ( but not yet divorce) and the husband threat her that he is goin to the emabssy on the day of her interview and file a complaint against her that she has an affair with other man or whatever reason he will tell? Is theres a possiblity that the office can entertain him on that day? or whatever?

If he tries to get in there, he'll be turned away. If he pushes it, he'll be arrested. You gotta have an appointment letter to get in, he doesn't have one.

I already explained to her he may get into the USCIS waiting room, but does not have an appointment to see a counselar. She is going for 3 year citzenship interview on marriage.

Well if she is separated she cannot do the 3-year rule. But he can't bust in and make a scene.

So there are a lot more questions and answers. Were they separated before she filed her N-400 or after. If before, were they living apart? If so, she would have had to indicate her present address as well as the address of her spouse. If they are different, the IO will likely question why they are living apart. Will that cause a denial, who knows. If they separated after she filed her N-400, she may still have issues as the IO will likely ask about her marital status and residences. She probably needs to contact an attorney and possibly take legal representation with her to her interview.

Unless she has already filed and is inline or scheduled for an interview. Could always withdrawal the application I suppose, but would lose out on the application fee.

To qualify for file for citizenship through marriage to a US citizen for three years the alien must be in a valid marriage and be living with the US citizen. If they aren't living together then she isn't qualified.

She needs to wait for the 5 years... He can't bust in there,but he can contact them and indicate they are no longer in a valid marriage thus denial as she does not qualify under 3 year rule... She needs to wait it out

Question may come in to play was it bonafide on her part,

then she 's applying at 3 yrs and they R separated...He may

need to go to USCIS and state his case, not bum-rush her

interview (for cirizenship I guess) and get arrested...then his

right would become a wrong

Since she is separated, the rule of being married to the same spouse may present a problem since one must furnish proof of ongoing marriage with financial comingling etc. It is better to wait and file for the naturalization in two more years with the 5 year LPR rule.
