the reason i ask about the cr 1 visa and the green card lottery i live in georgia and she move to california 30 day after she got her 2 year card that about 2 year ago and 2 day ago she told me a lawyer told her about the green card lottery how she apply for a green card lottery she here on a 2 year green card.. it hard get proof we not living in the same place when she move to california i know what will happen but i cant lie to uscis....

She already has green card and still a PI citizen, no DV lottery for her.

Are you saying you and wife are separated and looking for ways to get permanent green card, without having to file I-751 jointly?

what if she in the u.s.a on a 2 year green card can she still apply for the green card lottery if she already in the u.s.a and got her cr 1 visa and 2 year green card can she still apply for the green card lottery....

No. She cannot apply for the DV lottery because Filipinos are not allowed to enter.

It is strongly suggested you don't lie to CIS.

Under the circumstances, how will you and your wife prove you entered the marriage in "good faith" and not for the purpose of circumventing immigration laws?

Thank you merrytooth I knew this story sounded familiar.

She cannot apply for the diversity lottery. If she files for ROC with the two of you married she will have to provide a lot of proof of marriage. If she cannot provide such proof as a joint lease or deed, joint bank accounts, insurance policies, proof of both of you living at the same address, etc. the ROC will be denied. There are many people who ROC who receive an RFE for more proof of their marriage. If her ROC is denied her choices are to leave the US or remain here illegally.

If you are found complicit in attempting to help her obtain her 10 year green card.....meaning you lie to or provide false information for her to gain a benefit......this is a crime and you could be prosecuted criminally and fined.

Your wife sounds as crooked and ill-informed as the lawyer she hired. Why you are dealing with either of them is beyond my comprehension.
