hey guys, for AOS does nvc checks if one filed single or married? my wife is obviously not here in the states nor i have a number to claim her , even tho we are married in her country how can i file married if i cant claim her, theres a spot that if u file married it asks for her info.. i have a joint sponsor anyways , can anyone clarify please.

if you are in the usa and have a usa bank account,

i suggest you hire a teenager for about 2 hours a day, for the 6 days you'll need to check stuff online.

No, I'm not kidding, as teenagers are smart and know all about computers and stuff. all the forms you need are downloadable - a teenager can do that.

Don't know any teenagers, you say? Talk with the Imam at yer Mosque - he knows of many and can recommend several to you that will be good.

Same thing happened to my husband. Tax preparers aren't necessarily the best trained people in the world. They aren't normally accountants (who can get it wrong too.) They know the software they're looking at and that's it. Several suggested to my husband that he file as single but when he called the IRS they told him he was not allowed to file as single. He though it sounded odd as well which is why he called the IRS.

I also did not file as single in Canada because they already knew I was married. I received more of a refund because my husband was out of country actually and hadn't earned that much that year as well. You have to tell the CRA you're married within 30 days of getting married or becoming common-law, and within 90 days of separation.

I know it;s a huge thing with all the "how do I file" tax threads but I will never understand why people feel it's okay to say "yeah i'm single" on a form to the government. And they wonder how people get things they're not supposed to from the government as well? I met someone once who hadn't filed taxes in 30 years, but boy was that audit going to hurt since they had caught up with him and he said so to me.

I even filed taxes when I was in college because I made a little bit of money each year working for the school or my mom. I still have unused tuition amounts that help me get a refund 13 years after I've graduated and I only went to school for 2 years! Why wouldn't you want that?!

I agree with you. In my case, we got married in Sept. 2012 and I quickly informed the CRA because we are told to give them a call if your civil status has been changed with in 30 days and also because I filed for CCTB for our child.

if i am in us than i can do this the problem is i am abroad with my husband and dont have computer to download this stuff so i want them to send forum to my home address in US than my parents will fill up those paper and send it to NVC

My father will be the only joint sponsor. He files I864 and I file another I864 even with no income. And my mother files I864A since my parents file taxes jointly. Every other docs are ready. Do you think I should also send my parents marriage certificate along with AOS?

Read IRS publication 501 under filing status.My husband filing married separately and for spouse information (that's me) he put NRA (None Resident Alien) you could also do married filing jointly but you have to attached an IRS W7 form,more paper work but better tax benefits.It's all in that publication :)
