marriage based green card - expires in 10 years (not 2) marriage has been <2 years

Hi,

I have just recently received my greencard in the mail, after having the interview about two weeks back with my wife. (they were really fast, wow!) I was expecting the expiration date on the card to be 2 years (because of it being a conditional greencard since we have been married less than 2 years (one year to be specific)). To my surprise, it expires in exactly 10 years and two days after the "Resident since:" date.

How is this possible? Does that mean I don't have to worry about the conditon removal in two years? I would, obviously, appreciate that.

btw, I have originally come to the US as a f-1 student about 3 years ago and my wife petitioned me as a permanent resident (she is about to have her citizenship interview in a month).

Do not keep the card, it was a mistake and if you keep it and wait the 10 years your spouse will be overstaying their residence in the USA and will technically be "illegal"! Call and let them know they made a mistake, honesty is huge especially with immigration.

If you do that, in about two years you will fail to apply for ROC at which time your residence wil be considered abandoned and canceled. Just call them and have it replaced. It is a simple operation.

Protect yourself, not only call, but also write them a letter - document it!

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

My wife also received the 10 year green card after less than two years of marriage. After several inquiries and sufficient documentation we kept it.

We had no issues. She is now a US citizen.

If at first you don't succeed, then sky diving is not for you.

Someone stole my dictionary. Now I am at a loss for words.

If Apple made a car, would it have windows?

Ban shredded cheese. Make America Grate Again .

Wow So you cheated the system. Didn't remove conditions like you should have lawfully did (So the government lost $505 you not doing the right thing). And she got rewarded. Well good for you, but not something I sure would advocate. You were wrong and you know it. Edited by dwheels76

Yes, and it got returned with the check and a letter saying we did not have to remove conditions.

First off: I don't think it's right to keep the 10 yr Green Card if one knows that it should be the conditional one BUT:

Not everyone is so properly informed like us VJers! Some people just wouldn't know that they should have received something else. So IF USCIS sends out the wrong card they cannot (in my opinion) punish the person for not removing conditions.

But since you noticed it and know better you should inform USCIS about the mistake they made.
