So forgive me for being a little unorganised and unprepared... but, I'm a little stuck on what to do next!

I moved to the states on September 11th (so coming up close to my 90 day mark) and we married November 1st. However...we've not done anything since that day!

We've found out that a new fee of $1010 is now required (which is a wonderful surprise just before christmas) and we are wondering if this is due immediately?

We plan on filling and sending forms before November is through. Is it vital to send the money with them too? Do we need to send forms before 90 day mark, or is being married sufficient?

I also have found that I am required to have ANOTHER interview. Huh? Any ideas when this happens?

I was basking in the naive glory of believing the hard part was over. How wrong I was!

ALSO. On the health insurance part... which is all a little confusing right now... we planned to get health insurance (for me, my husband, and our son [ who is classed as an american citizen, but was born in the UK and moved here at the same time as me ] when I became a resident and we could do so as a family. However, our son, who is 7 months old & was 3 months premature, is in need of a flu shot, especially due to his preemie background. Insurance of some kind is required for our son to have a flu shot (idk why we can't just pay for it but HEY HO) I am wondering if, with my current status, I can be accepted onto an insurance plan?

Any help or advice would be much appreciated :)

The fee is $1070 and has been for years. Find the AOS from K-1 guide up top. You may have another interview, or it could be waived. You must send the money up front or they will not process your papers. There is no deadline to file AOS, but sooner is better, because until then you cannot work, cannot travel abroad, cannot drive, and you will start to accumulate days of overstay and be subject to detention.

For anyone else reading this: All K-1s need to realize that AOS comes after you marry; it is more expensive than the K-1 visa. Time waiting for NOA2 is a good time to study up on the next parts.

Maria, actually the fee is $1,070. Not to sound rude or anything, and I can assure you that you are not the only one like this, but I am always amazed at how people think once they have the K1 visa everything is miraculously done and paid and are super-surprised when they find out they have to pay more money for AOS and ROC. The AOS fee is not new at all and yes, it has to be paid right away. You cannot just send off the application and then pay at your convenience. USCIS is funded by fees - imagine what would happen if everyone paid the fee late or possibly never! It would turn into a total mess. They will NOT accept your AOS package unless it has a check with the right payment amount attached.

Since you came on a K1 visa, you may not be required to have another interview, but you will not know until you either get an interview notice or just your GC in the mail one day.

I cannot comment on the health insurance part, but I am sure others will chime in.

I'm by no means an expert on insurance, but I would imagine that if your husband has insurance through work, you and your son should be able to get on his plan as soon as you are married and have your social security numbers. But you have missed the 30 day Life Event Insurance change window, so you'd likely have to do it during open enrollment and not have insurance until Jan 1. If your husband doesn't have an insurance plan at work, then I have no idea what to tell you...sorry!

As for the fee, you absolutely have to send the $1070 at the time you send your forms. Otherwise they're reject your application. If you file for EAD (employment authorization) and AP (Advance Parole to travel) at the same time as your AOS forms, then fees are waived for these two (essentially covered in your $1070 payment).

If your husband has insurance, then you can get on his insurance plan. If you want to get insurance on your own, I think you can still get it, just might need your SSN. And it is highly recommended to file for an EAD and AP at the same time as your AOS, because they are free and whether or not you use them you will still have them. However, if you only file your AOS first and decide later to file EAD/AP, you can still file them for free you just need to include a copy of your NOA1 from your AOS application.

There is no reason why you shouldn't be able to walk into a Walgreens, CVS, Duane Reade, etc or Urgent Care Clinic and pay for a flu shot if you want one.

You are not a permanent resident of the US until you get your greencard. You were given 90 days to enter and marry. After that you have nothing showing you are allowed to stay longer, so make adjustment of status a priority.

You have been given some very good advice here.

As stated, the most important thing is that you have gotten married within those 90 days. No one will come knock on your door and put you in a detention facility on day 91 if you have not yet filed for adjustment of status.

It is important to note however, that you will be unlawfully present on day 91, and although it won't be an issue when filing for AOS, it should be a priority.

Thank you to all for the advice!

I am aware I should have been more prepared as to what was to come next (I was aware of more forms & fees, just not how much) but unfortunately, as stated, I spent the first half of 2013 in the hospital with my extremely premature son. My K1 Visa had to take a backseat, I did what I had to do when it had to be done, but other than that, I didn't think of it!

We attempted to walk into Walgreens for a flu shot, but they only provide to persons of 7 years and above. A baby needs to see a doctor for their flu shot.

Just to clarify the part where you wrote"when I became a resident" you are not yet a resident of the US until your AOS has been approved.

My husband got myself and our daugan hter of 3 months private insurance through healthplus because he is allowed to stay on his parents insurance until the age of 26. Im not sure where you heard you cannot get shots without insurance, in Michigan we went to the health department before I even received insurance because my daughter needed her 2 month shots. We paid $8.00 a shot, and she had 2 shots. No insurance at all.

I was able to add Joan to my insurance from my employer before we were married. We used a temporary immigrant insurance plan (I forgot which one, but a google search should do it) until she was under my policy. Good luck.
