hi,

please help ame shed light on this matter. i am the beneficiary, and my fiancee (petitioner) has just landed a new job. she did not make that much last year. i was reading the income requirement for k1 visa petition and we both agreed to have a co-sponsor. here are the questions that bothers me right now. please take time to answer them :)) i would appreciate it higly.

1. does the sponsor needs to be a relative of my fiancee (petitioner)

2. what form does my co-sponsor needs to fill up im confused whether its i-134 or i-864.

3. given the fact that we are getting a co-sponsor, does my fiancee still needs to fill up i-134?

4. up to how many sponsor are allowed for k1 visa petition? two of our friends wants to help.

5. how much does our sponsor should be earning so we odnt have any problem. il give you a little background.

1. sponsor owns a construction company in the US. he lives with his wife. so im guessing that his wife is his dependent? his wife is also working. given that, how much should atleast he makes to qualify?. my second sponsor is single, and living alone, how much does he has to make in order to qualify?

6. does my sponsor needs to have the form (i134 or i864) notarized?

7. does my fiancee's i-134 needs to be notarized?

8. what are the accompanying documents that my sponsor needs to send to us along with the form?

Hi I will not answer your question but will tell you that they don't accept a co sponsor in Manila US embassy it's on their website.

Petitioners in fiancé(e) (K1) nonimmigrant visa cases are generally expected to provide the adequacy of their own financial resources to ensure that an alien, after admission into the United States, will not become primarily dependent on the US Government for subsistence. While our immigration law does not disallow joint sponsorships for K nonimmigrant visa applicants, the mere submission of an I-134 Affidavit of Support from joint sponsors is not sufficient to establish that the alien is not likely to become a public charge. Accordingly, we make a thorough evaluation of other factors, such as the sponsor's motives in submitting the Form I-134, the sponsor's relationship to the applicant or petitioner, the length of time the sponsor and applicant have known each other, etc. An I-134 Affidavit of Support submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has limited value. Unlike the I-864 filed by joint sponsors in immigrant visa cases, the I-134 is not legally binding and imposes no legal obligation on the joint sponsor to make good on his or her promises. Please be assured that we look at the totality of circumstances in assessing the credibility of joint sponsorships.

Is your Fiancee's income from her new job adequate to meet the guidelines of the I-864P for the two of you? Then focus on providing evidence for this income; employment letters, as many pay stubs as you have. You will still need to bring the most recent tax return, but if the new job has adequate income that is where you want to shine.

As for you questions:

1) USEM can be difficult about accepting co-sponsors with the K-1 visa, but when the do consider a co-sponsor they want that person(s) to be a relative, so trying to uses friends decreases the odds of USEM accepting a co-sponsor, and the embassy doesn't always accept relatives as co-sponsors.

2 & 3) USEM requires the I-134 but it has been suggested many times to include the I-864 from the sponsor and co-sponsor. (6 & 7)The forms do not have to be notarized.

4) I don't know that there is a limit on co-sponsors, most only have one (or a married couple)

5) The I-864P is the poverty guidelines http://www.uscis.gov/files/form/i-864p.pdf

8) copies of the most recent tax returns, W-2 are the minimum requirements

How much IS the income requirement anyone?

Sept 7th, 2013 = K1 Visa Application Submitted

Sept 18th, 2013 = NOA 1 via e-mail - Case Accepted and Routed to Texas Service Center

Sept 27th 2013= Received NOA1 hard copy

Oct 5th-12th 2013 = Had an AMAZING week together and now back to waiting...ClockWatch2.gif

February 12th 2014 = Five month mark passed. Service request ordered. They said in 27days we should have an answer.

March 15th 2014 = ALIEN REGISTRATION NUMBER CHANGED! FINALLY! dancin5hr.gif

May 31st-June 11th 2014 -Spent a Beautiful week and a half together and got a huge surprise on the day before she left. :D

June 10th 2014 = PETITION APPROVED!!! Hallelujah! :dance:

August 8th 2014 = Medical. Results: Passed

September 23rd 2014= INTERVIEW: APPROVED! so happy!!!!!!!

September 25-28th 2014 = System Error prevents VISA from being issued. :cry:

September 29th 2014= VISA in hand :dancing:

September30th 2014= Entered the USA :thumbs:
December 22nd 2014=MARRIED :)

March 18th 2015 = Filed AOS

hi guys..im new here..we have kinda the same situation..here is our scenario..me and my fiance are planning to apply this year or by early next year probably january..but the problem is he just got a job this august..but before he didnt worked for how many months because his dad got really sick and had lots of surgeries,thats why he stop working that time when his father is ill..do you think we can push thru this and try to apply? thanks

i am the beneficiary and we got our noa2 already so we started collectign all needed docs as per visajourney's post. our problem is this: . my fiance's ITR for 2012 was only around 15grand. and according to income requirements, she did not meet the requirement. my question is. what other documents or anything that will supplement her to meet the requirement given the fact that her ITR for 2012 is only 15k. please help us. we are totally wreck right now with this. my fiancee has no other relatives in the US, so co-sponsoring is out of the question although i do have a second degree cousin who lives in the US and a USC whom i asked and is willing to be a co-sponsor. my consulate is manila, philippines. please please help me on this...

i am the beneficiary and we got our noa2 already so we started collectign all needed docs as per visajourney's post. our problem is this: . my fiance's ITR for 2012 was only around 15grand. and according to income requirements, she did not meet the requirement. my question is. what other documents or anything that will supplement her to meet the requirement given the fact that her ITR for 2012 is only 15k. please help us. we are totally wreck right now with this. my fiancee has no other relatives in the US, so co-sponsoring is out of the question although i do have a second degree cousin who lives in the US and a USC whom i asked and is willing to be a co-sponsor. my consulate is manila, philippines. please please help me on this...

For the K-1 visa Manila can be very difficult with allowing co-sponsors. If they accept a co-sponsor they want it to be a relative, now being the beneficiary's cousin is a new one so not sure how USEM will react with this. All I can say is try...

I suggest along with the I-134 both the petitioner and co-sponsor do the I-864 as well. All of this is still no guarantee as USEM is totally unpredictable with the K-1 in this situation. I would suggest you make a point of telling the CO that the co-sponsor is your cousin so he knows it is family.

Do your fiance only have an income of $15K even now? That could be an issue, even if they look at your co-sponsor, if they see the possibility of you becoming a public charge they will deny the visa.

For the K1 visa, using form I-134, it's 100%. However, for AOS you'll need form I-864 and it's 125% for that one, so a lot of Embassies choose to just use the 125% from the very beginning as it will be what is required later down the road.
