ME AND MY FIANCEE FILED OUR K1 LAST YEAR JULY 2012 TO BE PRECISE WE WAITING FOR A YEAR NOW WE HAVE DONE ALL WE CAN AND STILL NO SIGN OF NOA2 SENATORS,CONGRESSMAN ETC. MY FIANCEE TRIED TALKING TO A LAWYER AND HE SAYS SINCE WE DIDNT START THE PROCESS WITH HIM HE CANT BE INVOLVED BUT PLEASE SOMEONE OUT THERE HELP US WITH A LAWYERS NUMBER WHO WILL INTERVENE ON OUR BEHALF. I KNOW U WILL SAY A LAWYER DO NOT MATTER IN THIS PROCESS BUT WITH OUR STAGE NOW IT DOES PLEASE HELP IF U KNOW ONE WHO WILL TAKE OUR CASE..IT HAS BEEN A LONG WAIT..DO NOT WISH ON ANYONE

I'm so sorry to hear that! You didn't get any RFEs? Have you tried calling CSC?

Waiting for 9 months but with RFE, did you get any RFE, you can do service request. You may call the Uscis hotline number and request for one.

You are the fourth person on these forums that have the same rough NOA1 date (end of July 2012) that have yet to see an NOA2 from CSC on an I-129F. CSC is currently processing 2013 files. Therefore, the theory is that the box containing your files got lost or misplaced somewhere during the flood that occured in March. The others have been told to be patient, a couple found out theirs were "touched" a month ago, and one has set up an appointment this month with his local office to try and get more information.

Just take a minute... breath, relax. This is just a delay and you will find a way through it. Calm down, and think.

What else besides talking to the Congressman have you tried? And what did your Congressman tell you?

Have you checked to see when your file was last touched? Does the website show that you have an RFE?

Did you call into USCIS, and if so, what did they tell you?

Have you tried contacting your local office?

If someone did give you a number, what would you ask or expect the lawyer to do? What do you believe is within their power?

I understand completely where you're coming from. I had a lot of legal stuff I had to take care of before my fiance and I could even apply, and I had no idea how long it would take to get through that. It is hard, it's scary, but it's worth it. You won't be left in limbo forever, and you're closer to the end than a lot of people. Just keep in mind that the end is near, you just need to find that way that helps you get there. We are here to help you with that!

Getting a lawyer cannot help speed up your case approval, not from the beginning nor towards the end past processing times.

What did the senators and congressman do for you? What information were they able to get from the CSC about your case? Did you put in service requests?

Make Info Pass appointment. Do this on the USCIS web site. Go sit down with USCIS in person. A lawyer isn't going to be able to do anything you cant do yourself.

Given the country you are filing from it may be that your case has been misplaced. You mentioned something about senators/congressmen. Did your fiancee submit a formal request to them to inquire about your case? What were the Congressman's office's findings for your case? If she hasn't done it, she should now. There are a couple other things your fiancee can do:

- Ombudsman. Frankly I don't know if this will be helpful. USCIS is a bureaucracy, and a bad one at that. But it will be helpful to collect paperwork showing you used every option they made available to you in order to track your case. If your case file was misplaced the Ombudsman office should be able to determine where it went and what steps you need to take from there.

If that doesn't work:

- Find a new lawyer with experience filing a Writ of Mandamus. This is essentially a lawsuit leveled against USCIS for failure to adjudicate the petition in a timely manner. Notice of intent to file a writ (which is sent to the US Attorney's office and USCIS) may be all you need to kick their butt in gear. It IS expensive, I was quoted a bare minimum of $1500 to write and file the notice. But my case is different because of my beneficiary's country. Hopefully in your case it won't come to this.

What does the country of the beneficiary have to do with it? This is the i129f, not the K-1, so it is still in the USCIS stage here in the US.

I understand completely where you're coming from. HOW CAN I GET A LAWYER PLEASE WHO CAN FILE THE WRIT FOR ME MY FIANCEE IS SO DONT KNOW HOW TO DO ANYTHING WITH THIS PROCESS.

Without answers to the other questions, I don't know what else you've already tried, so I can't be of much help. The only advice I can give is to try the other routes available to you if you have not already done so. Others in your position have had attorneys and they weren't able to speed things up. The only option I can see that a lawyer could exercise is to sue the USCIS. If that is what you want, then call around until you find a lawyer willing to do this. Try more than one.
