I understand that, but they did not. It was a flat out denial.

She will most likely just have to wait for the letter, but I was making sure she knew what type of proof was needed at the stage to see if she had sent the basics... marriage certificate, divorce decrees if necessary, etc.

Just trying to help cover all bases as we all know the waiting game sucks!

A denial usually is something far more basic, like failing to submit the fee or failing to meet a requirement like being free to marry, etc.

Agreed - that is why my first post said:

"At this stage most denials are from lack of required documents, no response to an RFE or things like ineligibility... like you they think you were not legally married, or legally allowed to marry each other (no divorce papers, etc.)"

The only real difference with K-1 is you just need proof you are eligible to marry, have the intent and met in the last 2 years. The process is generally the same at this stage though. It changes at the next level.

There is not a lot to do at this point until you get the denial letter. Once you know the reasons you will know if you can correct and refile, and what options you may have.

Keep us all posted when the letter comes in!

as i said she got her NOA1 so all the papres are ok..but the denial is confusing !!!

NOA 1 has absolutely nothing to do with the papers and if they are "okay"

All that means is that they received the petition.

Sorry to hear that. Best of luck. I recommend you wait for the letter and then see if there is something you may be able to do. You may need to see a lawyer for options.

You will have to wait for the NOIR in the mail to find out what they need. You'll then have 30 days in which to reply. I'm sorry we can't you more.

The OP is in a different situation. The petition that was filed was denied by USCIS and the OP is being sent a denial notice that will state the reason and options. The OP will not be able to "reply with what they (USCIS) needs." The OP's options will be to start over at square 1 and refile (if possible) or appeal the denial decision.

Would they not send a NOID ? (sorry I wrote NOIR originally, which was wrong) Darnell received one of those and was able to send more evidence. Or would it be the straight up DENIED and you have to start over?

Since the petition never made it to the embassy there is no notice of intent to return or deny. There is a fundamental flaw with the petition that means it can't even move to the embassy stage for them to review evidences.

We received a NOID prior to the local office approving my husband’s petition for me.

We had 30 days to give them what they were asking for.

Sent it in and had our approval 2 1/2 months later.
