I met her two years ago online and decided to travel to her and meet her. After meeting her and her family, I decided to take it slowly and keep talking online. We kept talking online with skype everyday for over a year. Eight months ago I decided to start the finace papers. She was approved and got the visa few days ago. Suddenly she started demanding that i go to her country and make her a wedding even tough our agreement was that she will come here alone once she gets the visa. She is easily agitated and suddenly stopped communicating. She has a sister that lives here and I think her plan is to use the visa to come and stay with her.

What can I do now? Can I call the embassy and ask them to revoke the visa even though it's already issued and she got her passport back from the embassy?

Her K1 visa is classified as a non-immigrant visa, once used, she can never re-use it again.

As soon as she enters the US, you have 90 DAYS to get married. If you don't get married within that timeframe, she will be OUT OF STATUS and can be deported anytime.

If you go there and marry her, as she is asking, her K-1 will become null and void and no longer valid. You cannot enter the US with a K-1 visa if you are already married.

If you have doubts, you can call it quits now or test drive the 90 days. Every time I don't trust my gut I take it on the short end.

If you go there and marry her, as she is asking, her K-1 will become null and void and no longer valid. You cannot enter the US with a K-1 visa if you are already married.

This is correct. If you get married in her home country, she can NO longer use her K1 visa. K1 is for getting married IN THE US.

If you get married outside of the US, you will have to file i-130 (spousal visa, CR1 category) for her.

What about having just a wedding in China and then come to US to reguster?will that still be considered married??my fiancee really wants a wedding in China since all of her friends and family are there.

As long as it's nothing legally related and just a ceremony/party, I don't see anything wrong with it. And to the OP: I suggest trying to communicate better with her. My fiancee and I also have stressful miscummunication like this. Good luck

The visa was already issued right?..I guess they can get married in her country without risking the visa since it was issued..Guess it will work..Marry her in her country before flying to US..

If she's wanting to get married before travelling to the US then she'll need a CR-1 visa, not the K-1. The CR-1 is for spouses and the K-1 is used for those who wish to join/wed their fiance in the USA. She should've made up her mind before as to where the ceremony was to take place. I haven't done much research into K-1's since I married in Germany, but perhaps there are adjustments that can be made to turn it into a CR-1.

Not at all ! If she has been approved and issued a K1 visa the marriage must take place in the U.S. If the marriage takes place outside the U.S. then you must begin all over again using the CR1 and the process will mean you are apart for a similar length of time before she is able to enter the U.S.

If you are saying she is using this as access to the U.S. but not intending to be with you, then you are correct in thinking you have been scammed.

If you end up having a non-legal ceremony in her country first make sure she is aware that at the point of entry if they have suspicion of you two already being married they will not let her in despite having the K-1 visa. Be sure that if you exchange rings at the ceremony in her country she does not have it on her hand when she is going through customs and that she is aware that if they ask her about you you are not her husband until you have the civil wedding. If she refers to you as her husband rather than fiance or if they have reason to suspect you are already married at the point of entry she will have problems and may be denied entry.
