I guess I'm just looking for a little sympathy. We both transitioned from our jobs in Greenland 2 wks ago - me to the US, him to Denmark. I'm already working and he was going to come over and visit for 90 days while we wait. We have enough savings for this and I make enough to cover our expenses. He had a return ticket, but it was at the 85 day mark. The border agent felt that it looked too much like he was trying to illegally immigrate since he didn't have a job in DK, so they are putting him on a plane tonight back. We are late January filers so it may be a while. I guess I'll be traveling to DK soon...

That stinks :/ But if you're in an enough comfortable situation to travel to Denmark, you can be sure they won't deny you entry there.

That IS poo! I was denied entry twice so I understand how terrible and humiliating it is

If I remember right, Denmark is a member state of the US visa waiver program, isn't it? If he registered with the ESTA he should be able to travel to the US for up to 90 days without visa. If for some reason they turned him back anyway, maybe he could actually file for a visa and try again. In a way I guess the USCIS agent was right, as your fiance IS planning to emigrate to the US (with the K1 visa), but he should be able to come visit during the waiting time. I'm curious what your fiance told the agent at the POE. The agents usually base their decisions on answers to their questions, as well as the facts in the passport/visa.

Aww, that's poo. :( I'm so sorry that he was denied. Border control goes too far sometimes. -sigh- Hopefully you'll be able to see each other soon!

UPDATE UPDATE UPDATE!!!

My daughter called the border agent's supervisor to find out what happened and to file a complaint about the agent's rudeness (she was very nice about it).

Surprisingly, they were professional enough to take a second look at the case. A second agent called me to find out our filing information and case status, etc. Luckily, when my fiance left his job in Greenland, it was just on a leave of absence status, and that's what saved him in the end - I think.

I believe the first agent was intimidating and not patient with answers or lack of understanding on his part. But the 2nd agent called and not only was very nice, but also said he couldn't understand why it was denied in the first place. He asked me lots of questions, and it appears they asked both of us the same questions.

But in the end they allowed him entry! Not in time for any flights out tonight, but we'll take that and find the first flight out in the morning. What a day!

We got lucky with this one and we won't push our luck again. But the lesson for everyone else here is maybe to try one more approach if anyone ever gets denied at the POE.

Maybe you can help.. I never got a real answer to this. If you are denied entry, do you have to pay to change your flight from your originally scheduled return?

Thanks. I asked the 1st border agent if we needed to get the return ticket and he said it was the airline's responsibility to take him back. I believe in their way of thinking it is the airline's responsibility to properly screen their passengers and if they don't (or the border agent has a bad day and denies someone) they just blame the airline. Whether they, in turn, charge a separate fee is still unknown. Glad I didn't have to find out the hard way.
