I can't speak for your state, but some do require a non-expired visa or proof you've filed for Adjustment of Status. If the K-1 is expired, I assume you are now married. To get the ID, you'll probably first have to file for AOS.

the k-1 visa is invalidated on the poe date, so any concept of it 'expiring' is inaccurate.

the dates on the I-94 are what govern most things for a k-1 visa holder, when trying to get ID, a SSN, a drivers license.

For IL and your experience, it smells like you not have a trained human . A trained human would know the K-1 visa is different.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

For IL I found this with Google about what is required, have a look. Does the immigrant have a SSN yet? As previously mentioned by Darnell, the K-1 expires once the fiance(e) uses it to enter the US. The immigration status is then in the I-94 form. When it expires you have to wait for the GC to prove lawful presence in the US. We did not try to get an ID or learner's permit until my wife had her GC for quite some time. She wanted to study for the written test which took her a few months.

Hi! We had the exact same problem as you, but it's not anything you did wrong - it's because the people at the DMV don't know what they're doing. This is a horrible stereotype of all DMVs that happens to be true LOL. Are you near the Chicago area? Just try going to a different DMV.

When my guy and I went to our local DMV to get a state ID for him, they said the exact same thing. They looked at my guy's passport and visa and they said they couldn't issue a state ID because the visa date on his K1 was less than four months to expiration. That's how all K1s are printed. When I explained that this was a K1 visa and not a work visa, they sent us away and said there was nothing they could do.

Now, I did my research so I know that in Illinois, to get a state ID, having a valid social security number is the main thing they need. For IL, at least 6+ months ago when we did this... you'll need the social security card, proof of identity (valid passport, not visa) and proof of residence. The proof of residence can be the letter that the social security administration emailed you and your spouse signing a form saying you live together.

So yeah, try going to a different DMV with those three things and you should be OK, unless there was some sort of law change I don't know about.

Where are you in Chicago? Send me a message if you need more info, but if you can get out to the north suburbs, try going to Niles. As soon as we walked in, the woman knew K1 visas and all the requirements and we got my guy's state ID right away. He went back to that same location to get his driver's license a few weeks later and there were no problems.

I wish there were a more uniform guideline with the requirements for states to issue IDs, driver's licenses, etc. to new residents!

Luckily for my guy and the OP, I think Illinois is pretty lenient, if you go to the right place. When my guy went a few months ago, they didn't ask for the I-94 or any proof of AOS, etc. It was all about the social security card. I really think in the OP's situation, it was the result of people not knowing what they're doing. Anyone else from IL on here have any additional insight? :D

I just returned from 2 DMVs in IL (Bridgeview and Naperville) and they didn't allow my wife to get a state ID. I was informed that there is a new law that requires 6 months of validity on the applicant's visa. I was hoping that since she has a SSN, she would be able to get a state ID but no luck yet. I will probably try again at another DMV once she receives the EAD.

In Georgia, at the least, the EAD and SSN is required. :thumbs:

An SSN is not proof of legal presence. It is ONLY a unique number to track earnings and retirement benefits from the Social Security Administration. It is NOT a national ID number, and NOT proof of anything.

Illinois actually one of the States in the US that does not require legal presence.

You can actually obtain Driver License or ID card with

1. A Valid foreign passport

2. Birth Certificate

3. Social Security Card

4. Bank Statements

5. Report Card or Rent Agreement or Deed or Mortgage documents or Utility Bills

You bring these 5 documents and you will meet the acceptable identification documents for Driver License or State ID in Illinois.
