VWP get married and Adjust status( I-485)

I would like to ask on the form I-485, on Part 2 which status do i have to check?

I didn't entered as a K-1 fiance. I am a tourist in US with VWP and just get married 5 days before the day i have to leave US. And now I apply for package I-485 and I-130

And my divorce decree is added on my birth certificate, so do i need a Divorce certificate or just mentionned on my package "Marginal notes recorded on birth certificate"?

Please help!

Did you bring all your documents with you and had it all prepared when you entered on the vwp?

On part 2 you fill out h, other, and explain.

If your birth certificate has all your info on divorce you should be golden.

Oh la la, I've sent my package and for my situation I've check B

A. An immigrant petition giving me an immediately available immigrant visa that has been approved.(attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petitin filed with this application that will give you an immediately available visa number, if approved)

(I do not have a immigrant visa, how could it be approved?)

B. My spouse or parent applied for adjustment of status or was granted lawful permanent residence in an immigrant visa category that allows derivative status for spouse and children.

So if I've check the wrong case, will they return to me the package or not?

So if I've check the wrong case, will they return to me the package or not?

They might:

1. return it,

2. they might accept it, process it and RFE you OR

3. they might accept it, process it and deny you (thus losing all your money).

I've been told #3 is unlikely to happen but technically you aren't eligible for that, you won't be able to present the information they need to process it as a B... so only time will tell.

Why did you ask this after you sent your package out?

They could also correct the mistake themselves.

I know i have to wait but I scare it's to late for me...and i don't want to stay in the US with an illegal status.

I pray they will return the package for me or they will correct the mistake.
