Aloha Everyone,

Hope someone could help me with this.. I just got here in Hawaii for 2 weeks, and sad news came. My Mother died, and its very hard for me now that I am so far away..

Im just wondering if I could go home right away that I still have I-94 which is not yet expired. We are not yet married too.. I will just go home for a couple of days and come back here..

How can we do that? Where to go? really need help..

I want to see my mom and say goodbye for the last time.. I know its expensive to go home and Im glad my fiance is very supportive of that.. Im so thankful...:-)

Thanks everyone for your reply!

Mahalo!

Sorry to hear about your loss.

Your K-1 Visa is a single entry visa. You won't be able to re-enter the country with that visa. That would mean filing for a new petition & visa.

First, condolences for your loss.

Next, make an InfoPass appointment at your closest USCIS office. You'll need to explain your situation and request advance parole (permission to re-enter the United States) because regardless of whether your I-94 is unexpired, the K-1 visa is good for a single entry into the United States. If you leave without getting advance parole first you stand a significant chance of being denied entry and having to go through the entire K-1 process again (or else having to get married in the Philippines and apply for a CR-1).

I've heard of people in similar situations getting lucky and being readmitted on the strength of the used K-1 visa and the unexpired I-94; don't risk it. Make an InfoPass appointment, explain your situation, request advance parole, and make sure you'll be able to come back after you've said your goodbyes.

Thank You so much for your help.. We will tryto check about that..

Mahalo! God Bless!!

~~~~Moved to Working & Traveling During US Immigration, from the Philippines forum~~~~
I'm sorry for your loss.
You may also want to call the Consulate that issued you the k1 visa. Some ppl have been successful at getting the consulate to re issue the k1 as long as they were not married yet. Also it is only valid for the original length when it was first issued.
Another good suggestion. I've heard of this being done successfully in the past. good.gif
Improved USCIS Form G-325A (Biographic Information)
Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
You have to redo medical, get new police certificate, I-134 forms..etc, and schedule a new interview again (before the original 90-days is up) for re-issue of K1 visa.
Done with K1, AOS and ROC
You need to make an immediate INFOPASS appointment to find out your options.
Typically, you would be unable to get AP without first having been married and filing for AOS. BUT because you've only been here for a short time look into the K1 visa reissuance. You wouldn't be able to stay in your home country for long, to make sure you're back before the original I-94 expires but it can't hurt to ask!
Good luck.
Try doing a walk in infor pass without an appointment. There may be options , you may need a quick wedding then emergency AP.
This will not be over quickly. You will not enjoy this.
They will require proof of death , have a telegraph overnite to you, have the death announcement faxed to you, or other death proofs in your country and you will get the advance parole, but you have to return to the US before tge letter they give you expires...... sorry for your lost hope things work out for you.
Oh, wow! That's a lot to deal with, and try to get an exemption. I hope it works out for you. Hope we can all learn from your example, but don't have to repeat it. God bless you and your mother and family! Your husband is a trooper. I hope you can return soon.
