Sent I-129F application form and check payment without other requirements

Hi guys! For 7 days now I have been all over this very helpful website regarding the process and guidelines for K1 visa. My fiance recently came here in the Philippines to visit me and as soon as he got back to US he filed the petition. He was asking me to search on websites regarding how to go about the process right before he came so we can plan and make the process faster and unfortunately I have not read about this VJ website until now. I told him to file I-129F with the check money without submitting the other requirements. He filed the petition last October 3, 2012. I know this sounds dumb and my thoughts were to apply, pay and wait for them to tell you what requirements to submit. We knew we did it wrong and so a week after he said the money got encashed. For sure we would get an RFE but my question is how long do we find out if we will approved from our petition since we only submitted the I-129F and how many months before we get the RFE? Can we just submit the requirements before they tell us to submit it since we already knew we filed it incorrectly? Help from you guys will be highly appreciated! Thank you!

Sorry, but you most likely will not get an RFE at all and just get a denial. Several others that have sent in nothing else but the form and a check have just been flat out denied and lost their money after months of waiting. If they already cashed the check, most likely you have lost your fee and will need to cancel the petition and re-apply following the guide here on VJ: http://www.visajourney.com/content/k1guide

Ok, you probably won't get an RFE, you'll get a denial and then you'll have to refile. Sadly it looks like your cheque has been cashed so you'll lose time and the money

The instructions for the I-129F are written clearly and are very specific about how the petition should be filed. Next time please take the time to read the instructions, at least twice, and make sure each of you fully understands the instructions and what needs to be done even before filling out the petition, let alone writing a check. Best luck next time.

Even if you haven't known about VJ site, still the I-129F Instructions was in the USCIS site. But, what's done is done.

They are not going to send RFE for all the supporting documents. That's almost like the whole package.

There was a recent post like yours & the petition was denied. It wasn't until many months later ( I believe it was 7 months) that the denial letter was sent to the petitioner. The check was cashed too.

they wouldn't even reconsider if it was the first application? I feel sad my fiancé will get mad at me if I tell him about this..can I call and ask them about it?we actually try to get hold of the mail the next day when I found out we did it wrong but sadly the people at the post office didn't helped us..thank you for help guys..

No, they won't reconsider at all. It will be unfair if your fiance will blame it all on you. As the petitioner, he should have taken the time to read everything about the I-129F from the USCIS.Gov site.

Hi jay-Kay! Thanks for help and reply..should we wait till we get the denial letter or we can call and cancel and re-apply again?would this denial another basis for succeeding denials in the future? I very muh appreciate your response..

He actually left all the readings to me because of his too tied up with work. Thanks for your response..I again wants to ask if we should just wait for the denial letter from them or we can call and cancel since we knew it would be denied and then re-apply again?would this be a basis for succeeding denial in the future?thanks a lot!

Your ONLY chance to save this application is to send the documents that you forgot with a copy of the receipt notice (NOA1). This has worked sometimes, and not worked other times... so don't expect it to work, just be happy if it does!

Read the guides, gather the documents ASAP and send them in. Just hope they meet up!

Hi Vanessa&Tony.. We actually didn't get a NOA1 yet we only found out the checked was encashed thru his bank..thank you for help.

That's fine. You can still start collecting the documents now (you also need to send him a letter of intent and something else I believe.. it's been a while so read the guides and instructions) so by the time he receives the physical NOA1 he can forward the documents with a COPY of the notice. He should be keeping a copy of everything and only sending originals when specified.

Alright..Thank you! Did u had the same case or you knew someone who did the same?..thanks for the positive advise..I got devastated but after reading your post somehow gave me a chance..:)
