Research on how unemployment works... I don't think its considered as income because the individual would be a public charge. And also one who is getting unemployment must have been working for an employer and was either fired or let go for a reasonable excuse.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Why don't your finance make a trip down to the un-employment office and ask. No one here can answer such a question here that has some many variables.

Life's Journey is correct there are many things that come into play when filing for unemployment. for example the reason she left her last job, how long she was unemployed, if she paid into unemployment in the right time period, there are so many variables. As for public assistance Unemployment is not public assistance. It is an entirely different program than public assistance. Best advice if file with your local unemployment office and see if you are approved or denied.

I actually don't think its a good idea. The idea is to demonstrate that your fiancé can support you when they brings you over. Unemployment benefits suggest otherwise.

I would look for a co-sponsor (if that is accepted for K1s, I am not sure) or just look for a job and demonstrate an income that enables him to support the household.

08/01/12 - AOS/I-864 accepted, Checklist Issued for DS-230

08/13/12 - Responded to Checklist

08/20/12 - IV accepted, Case Complete

09/14/12 - Interview date Assigned (Interview Date: 10/04/12)

If your fiance quit to come stay with you there is no ability to get unemployment. Even though each state has their own rules for people that pay into it, quitting is one thing that makes it so you can't collect.

This will not be over quickly. You will not enjoy this.

We had our interview on September 23, 2012 and we got AP. My fiance went back to USA and looking for job. We have co-sponsor. Can my fiance apply for unemployment or not?

They have a co-sponsor already. The USC can apply for unemployment, if they are eligible for benefits. There are others on VJ that are currently receiving these benefits.

The OP would be a burden to the co-sponsor supporting them, a private individual not society. And, if the SO is indeed eligible for unemployment benefits, it is NOT a public charge issue.

If you are worried about umemployment and sponsors, then you should not be think about getting married. They don't go hand-in-hand. One issue at a time. Geez.

18 Mar 2010 - Met up in person for first time in CA. Best vacation ever!

21 Apr 2011 - He proposed!

28 Mar 2012 - Sends in I-129F

02 Apr 2012 - Received NOA1.

05 Oct 2012 - Got RFE.

10 Oct 2012 - Sends in RFE as requested.

29 Oct 2012 - NOA2 after exactly 7 months!!!

If you are worried about umemployment and sponsors, then you should not be think about getting married. They don't go hand-in-hand. One issue at a time. Geez.

K-1 beneficiaries require a sponsor so that part of your statement is irrelevant. Even the government recognizes the possible need for a co-sponsor, job or not. Just because someone doesn't have a job now doesn't mean they won't have one by the time the OP is in that stage of the process. It's up to the government to decide if the intended immigrant will be a burden or not. That's why the processes are in place.

Oftentimes, love happens under circumstances in which ideal conditions are not in place.
