Interviewed, house visited and still no decision 4 months after interview

Hi there,

I utterly need your help. I am just so confused, the whole process is becoming a very tiring process for my husband and me.

Here is our story:

We got married last Sept, so it's almost a year now. Our application packet was sent in Nov., 2011. We got interviewed in April. At the interview, we were separated; however, no sensitive or too personal set of questions were asked. No decision was given at that time. More than 3 months later, there were 2 officers showed up at my door wanting to check my place. It was a very bad timing since my husband and me had a fight, and he moved to his uncle's not too far away from my place.

However, I heard stories that they will check my husband's uncle's house to clarify things or call my husband. The officers did not take any of these actions. More than 3 weeks from then, I still haven't heard from the USCIS.

Side story, me and my husband had made a request and received a reply from USCIS that we can expect to receive a notice of other action or decision from them within 60 days. The last day of that 60 days term is on August 25. They came and check my place on Aug. 14. So, does that consider to e other action from them? I just don't have a clue.

I am thinking about writing to them to explain our situation. Oh, and I am a Vietnamese, he is a Sudanese. The officer who came to my house said to me that "Love does not just happen." I felt so disrespected and discriminated. Should I make it a point too if I write to them?

So, my question and I hope you guys can advice me on this matter is: whether I should write to them or just keep waiting patiently? How long do you guys think from the date we got the house check until we can hear from them?

Any advice will be greatly appreciated by me and my husband.

You should get a good immigration lawyer. This is beyond DIY.

Either way, this isn't good. I'd be willing to bet you'll be denied. You need a lawyer at this point.

I agree, get a lawyer. They came to your house because they strongly doubted your marriage was legitimate and when they showed up, you and your husband were living apart. You may have a valid reason but that doesn't look good to them. You need to be prepapred for the possibility of a denial and fighting against that is way, way beyond DIY. Best of luck.

10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.

11.08.2010 - Text/Email (3rd) - EAD approved

12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

Your case is in AP.. This is a common scenario and happened to us... We didnt have the hurdle of the argument and not being together. The case was in AP after the interview because they had some issue with the case. Now that they showed up and asked questions.. they likely did not get the questions answered to satisfy the issues.... There is nothing that you can do at this point aside from wait for them... They will send you a letter saying one of two things... get your documents updated and bring them to the consulate.. or your petition has been returned to USCIS. At this pint the file is in the hands of HCMC consulate.. USCIS can't do anything.. it's all up to the CO handling the case/investigation.. Read through the AP pinned topic in the VN regional forum here in VJ.

Did the OP states that she was overseas? Why would she need to bring updated documents to the consulate?

OP, you need to find a good immigration lawyer because most likely your case will be denied. USCIS officer showed up at your place because they had doubts about your case and them finding you living alone without your hubby confirms everything.IMHO, writing them at this point explaining your living situation is not gonna change anything. Just wait and see how it all plays out, but in the mean time start searching for a lawyer..

Thank you for your advice. But I am currently in the US. How did your case work out, can you tell me a little bit?

I am in the US. My friend, who went through the same situation, appealed the case on her own actually got it settled and they got approved. However, everything went pretty fast for them while it's dragging out for me. That's why I am even more confused and do not know if this is abnormal.

For my friends' case, they got separated at the interview. USCIS officers showed up at their place the next day with none of them presented at home. One of the roommate told the officers that my friend did not live there with her husband. The next day, they got called in the office, told that their case was denied and they had 30 days to appeal. It was like click click click. My case has been dragged out for more than 4 months and I do not know what is going to happen now. I am so worried. Do you know anyone who had to go through the same process as I do?

Contact a lawyer, that is very good advice. You can also write a letter to your State Senator or House Rep. They often can get answers that us normal people can't.

- 2/27/2013 USCIS online update - 485 decision!! we mailed you a notice that we had registered this customer's new permanent resident status :) Later, my 130 update too!!!

I really hope you guys get approved. But it was very rude of the officer to say that "Love doesn't just happen"!!! I mean, really?

They have no right to judge you based on how different races you are. Yes, the visit & the fight had bad timing and yes,it looks bad, but just have faith. And talk to an attorney who can help you with all this.

We'll be praying for you.

As everyone else said, get a lawyer if your husband and yourself are still together and committed to working on the marriage. I think one of the other best things you can do is move back in together, but I could be wrong.

Anyways, try to talk to immigration lawyer i think that's the only option you have right now

I wonder what triggered them to do a house visit. Even if he moved, there should be some trace of his existence in your place like his clothes, pictures, etc.
