Hi all,

Im new to VJ and i''m not sure that I'm even posting inthe right forum. But i have a dilemma and i would really like some help. I over stayed in the US and recently submitted my AOS package. While i have been here i worked the first year and filed taxes(with ITIN) as self-employed. Then i stopped working. Last August i worked with a family for about 5 months and didn't file taxes but when they did their taxes they declared payments for child care with my name and ITIN number listed on there 1040. My problem is when i filed my application on my form G 325a on the part where is says to list your last 5 employers i didn't disclose my work history. Is that going to be a problem. Will USCIS be able to see my employment history when they do the background check? Does the USCIS have access to IRS information in their background check

That's what i figured :( I figured it was only 5 months and temporary. Should i send a new form G325a with the correction. Will that help or make it worse? Thanks for your response

You have opened a real can of worms here. First, you lied on the G325A by not disclosing your employment history. Second, your tax returns that you must submit with the AOS will not match if you just correct the G325A. Even if you correct the G325A and file an ammended tax return, you can be denied based on misrepresentation and that is very, very bad. Fix what you can and see where the chip fall.

I did not submit any tax return with my AOS. We only submitted my husbands tax transcripts. I'm scared to even attempt to fix it. I listened to an immigration lawyer and lied on the form. He said the uscis had no way of finding out about my unauthorized employment since the IRS don't share info with USCIS. After we sent the application i just had a bad feeling that i had messed up. I went against my better judgement although i had read somewhere that's my unauthorized employment would be forgiven because i married a USC. I'm so bummed.

Are you saying that a lawyer advised you to lie to the US government? If so, could there be any kind of malpractice? :blink:

Unauthorized employment is forgiven, but lying is not. Sorry, but liars and cheaters who try to get around the system we all had too suffer through get very little sympathy 'round here. Personally, I hope you get denied and deported.

I don't maybe a sticky should be made for this.

One can listen to lawyer but have to make a personal judegment about not disclosing the information or lieing on immigration form.

The outcome is not going to impact the lawyer, he has already made his money it is the applicant who is going to be impacted by the outcome.

Good luck and hopefully you are able to resolve this problem successfully! From personal experience, the IRS has full access to your tax records. I was asked about something 13 years old during interview. Never, ever lie to these folks...

Thanks for your support. I called another attorney and he said he wouldnt recommend that i try submit a new form G 325a until i hear from USCIS. He basically said what u did. Hope for the best but expect the worse and gather all information i can regarding my tax payments

Did you mean to say the USCIS have full records? I hope i am another attorney told me the two agencies don't share information cuz the IRS is not allowed too. But who knows. I'm definitely not hanging my hat on this. They're both government agencies i should've know better

I am assuming you didn't come in on a family-based visa so I am going to move your thread to the AOS From Work, Student, and Visitor Visa.

No i came on a visitor's visa about 8 yrs ago and recently married my USC spouse whom i'Ve been dating for 2 yrs. I only held on temporarily for this family while their babysitter was dealing with a famly emergency.

So, if you get asked about it in your interview, tell the interviewer this. I'm not saying to walk in there and just start spilling every dark secret you have. But if they ask you, assume they know all, and just be honest. Hopefully you'll get an understanding interviewer who will allow you to correct your mistake.

Thanks for the advice. I intend to tell the truth if they do ask. I wanted to send a corrected G325a but a few lawyers i spoke with advised against doing until they ask for it. They said i should leave it be until something is said since they may not even question it. I haven't heard anything from uscis as of yet since i just submitted my packet. Only the text notifications were sent to my spouse.
