Today its been 5 months... And no NOA2

But I wanted to ask for your opinion on this, since those topics are from 2010. We received our NOA1 on June 13, today it will be 5 months without any further news. We contacted USCIS customer service center and they sent a letter that wasn't useful at all, it only said the date in which our petition was received.

Should we go ahead and try the baddass congressman intervention or wait some more? Its sooo frustrating.

The 5 month posted guideline is just that - a guide...

Here's the bottom line - USCIS isn't mandated to process petitions in any specific time frame. There is no law that says they MUST process our petitions by "x" or they face a penalty of "y".

Unfortunately, the answer is that USCIS will process the petition when they process it. Congresspersons can make inquiries as to your case status but odds are they won't get any further than you will by calling.

USCIS can just as easily change the guidelines to 6 months or 7...

All we can do is sit back and wait for the text, email or letter in the mail.

The average processing time is 5 months. If you haven't received your NOA-2 after 5 months, you may start calling USCIS inquiring regarding your case. Hope that helps.

Hang in there. I know its easy said then done. Im also a May filer who still waiting approval. I received RFE back in september. My 60 days will be up on wednesday. So I will be calling that day if I dont hear anytning before that day. I can just pray and hope that everyone get approve soon so we can all move on with our lives.

Unfortunately for us that submitted our applications at VSC, they recently changed their estimated processing times from 5 months to March 15th. We can no longer call and ask for expedite service requests because they will say that we are under their current processing times (given that they claim to process March 15th).

I read in a post that you can expect to get "help" from your congressman if you have an underlying urgency to your application. I however would advise everyone that waits over a certain # of months to contact them, even if they don't help at least it may become an issue for them to realize that there is something wrong with this process.

Ps. On the USCIS site they change theier estimates every month at / about mid month, I am curious to see if they change the estimates for VSC ( and I truly hope they wont change from March 15 to March 16th)

Thanks, I guess waiting would be the only option for now...

I contacted my congressman's office at about 5 months just to get a case file started in the event there was a much longer delay. They were very helpful and sent me a form to fill out and suggested that I get back in touch with them in 30 days if I hadn't heard anything. It made both of us feel better to be proactive, it doesn't cost anything and after all they are public servants.
