My fiancee is pregnant and I'm about to submit the I-129F

We just found out yesterday that my Ukrainian fiancee is pregnant. (BTW, we are very happy about this :-D)

However, we haven't submitted the I-129F yet, we are collecting paperwork as fast as we can.

I have read that I'm supposed to submit a letter indicating that I know she is pregnant and that I still want to marry her. Do I submit this with the I-129F form or does it go with her to the embassy during her interview?

ONE OTHER QUESTION: Is being pregnant grounds to speed up the process?? I really want the baby born in the USA and not in Ukraine, specifically because it will slow down the process more with more paperwork and because I want to be with her when she gives birth and the father being with the mother is STRICTLY not allowed in Ukraine. (#######!)

Thank you for any help

David and Irina

I am pretty certain I have seen from other members in the past that being pregnant has absolutely no effect in speeding up the process. Just hope you are in a California Service Center state so she can possibly get here before she gives birth.

9/23/2010 NOA1

10/3/2010 Touched

I have never heard of the letter you mentioned - I don't think that is true at all. (Everyone submite a letter of intent - no difference whether a pregnancy is involved).

No, getting your fiancee pregnant will not speed up the process.

First off Congrats on the baby! And I wish I could tell you better news about baby rushing the K-1 process. We just had a baby on 31 Oct 2010, mailed our packet early Oct...NOA 1 15 Oct. And still have YET to hear a single peep out of VSC. So frustrating. I have 2 kids here in USA from previous marriage, new baby and still waiting on this K-1. It's so frustrating. I'm holding thumbs that you all have better luck with faster processing time....we're still waiting. :(

I definitely did not get her pregnant to speed up the process. It was unintentional. Perhaps though I should leave it out for now and send such a letter to the interview when she goes. The goverment might think that I got her pregnant to try to speed up the process. *sigh*

That's silly. You only submit the standard intent to marry letter, both of you do. It is implied that you also will bring the infant(s) into your family also.

Looking through the forum I've found this topic http://www.visajourney.com/forums/topic/279895-k1-visa-pregnant-benificiary-question/ so maybe you want to take a look.

Personally I don't think it can speed up your process, but it's surely a blessing. Congrats to the both of you!

Thank you everyone for the warm wishes for our baby :-) Truly he/she is a blessing and God wanted him/her to be with us. :-) We'll find a way with faith, prayer, and a few good letters to a couple of Senators and a Congressman (in the near future because I'm a determined Daddy). :-)

Dont count on her being pregnant speeding up the process--instead some embassy needs a DNA test .--just a heads up

Have a look at the CRBA process and getting a US passport for a baby, good to research it before hand so you are ready when/if you need to do this for the baby if its born in the Ukraine.

Officially the government doesn't care that she's pregnant. It won't speed up the process, however at difficult consulates, having a child might help the outcome of an interview. Reason being that the "official" mission statement of USCIS is to reunite families. I'm speaking from experience, btw.

First off congrats on the baby.

Secondly, I wish I had something better to tell you. But I see that you list the Vermont Service Center on your filing location. Because the VSC is so painfully slow, it is almost guaranteed that your baby will be born in the Ukraine. Most people at the VSC are waiting in the 6 to 7 months range (including us) right now for approval and it is getting slower by the day. When you actually do get approved, there is still a 2 to 3 month wait until the embassy interview for most countries.

So sit back and prepare yourself for a long and frustrating process. You will need every ounce of patience you have.

When the baby is born you should report it to the US Embassy. Since you are the father and a US Citizen, the baby will automatically qualify for US Citizenship and a US Passport. So only your fiancee will have to apply for the visa and AOS.Just make sure that you are listed on the birth certificate as the father.

Hang in there.

It has -0- affect on the speed of processing. You MAY need the letter at the interview but not for the I-129f. The preganancy need not be even mentioned at this point.

If the baby is born before her visa is issued the baby will add a "family member" to your affidavit of support and the baby will not be eligible for a visa. You will have to get the child a US passport and register the birth abroad with the consulate in Kiev. It wil not delay the process of your fiancee's visa.

If she is in Ukraine when she gives birth you will have to be there if you want to be with her.
