Hi Mari! thanks for the reply. let me clarify a little bit.. will they ask me for any papers during the interview at the consulate in regards to how much money i have?

I just read some poor soul on this forum that got decline due to his affidavit was a few dollars short, now suddenly i got nervous myself.

My fiancée in the U.S didn't work last year, so he's not in the tax system, but making enough money now this year. i hope they wont make any fuss about it

Do you know that your Timeline says that Anita is the Petitioner and Rob is the Bene? OK this is why I am confused.... From your post, you are the foreign national, right?

No, its not likely they will ask the Bene how much money he or she may have because you are not married to the USC yet and the money is not jointly accounted for as they would an I-130 (spouse / immediate family visa).

Dept of State's requirement is that Rob is the responsible for all financial support via the I-134 Affidavit of Support. They want to be sure while you are here, unmarried, you will not become a public charge. Within or up to 90 days expire date of this K1 Visa (and you got married within that time), then you both will file AOS plus the I-864 Affidavit of Support (Rob will do that part).

Re Rob's 2010 taxes: The directions state the Petitioner must show either his 2010 Tax return (filing), or their IRS Transcripts. If Rob did not file, because he did not work --- then he must write an Affidavit of why he did not file taxes in 2010. I believe it is the same if one doesn't pay taxes either --- the Embassy will require an Affidavit letter of explanation as to why with proof. Please check the instructions again for this.

For this year, it's fairly simple for him since he is working. Letter from Employer, last 3 paystubs and the I-134 with the other supporting documents like his bank verification letter and proof of assets if any.

So I went to my CPA to finalize and double check my information on the I-134 & I-864 (for later on bc it's hard as heck to get an appointment with my CPA). I wanted to make sure that the amount of money made was Gross before deductions or Net after the deductions were removed. We couldn't find it in the directions so I called the NVC. The lady told me the amount is Gross before deductions on the I-864 Affidavit of Support. She said I'd have to cal the USCIS if I wanted to know about "Gross vs. Net" on the Fiance I-134 Affidavit of Support.

Then, because I was on the fone with her, I asked if she could check our status for Embassy. "Oh yes, no problem. ... pause.... your file left on April 28th to Ankara" I thought she would give me their standard canned answer: No it's here call back in 2-4 weeks, but she didn't. <NOW MARI HAS BARF FEELING AGAIN but I was smiling big too>

K' just happened to call a minute after that and I let him know "You now have to get back to Turkey!!!" He told me they will let him go in 20 days! Yeah!!! :dance: I FINA-PICKEN-LEEEEE get to see that man on a normal cam and have normal fone calls without a timer on! I am more excited to see his face than anything!! :wub:

Gross versus net depends on how you earn your money. If you are employed by a company and issued a W-2, the calculation would be based on gross. If you are self-employed, the calculation would be based on 1040 C net profits.

You wouldn't want to report net from your job because that number can be very skewed based on voluntary deductions (such as 401k contributions or health insurance) for which you should not be penalized.

On the flip side, it wouldn't be fair to allow you to report gross income from a business because you could have $1 million in sales and $999,000 in cost of goods sold and other expenses that are fixed leaving you only $1,000 of actual income.

Just to be sure, I googled it and am referencing a website that assists in applying for visas.

This reply is exactly why I had to go to the CPA! LOL Because I can't count!

One of the biggest issues I was having was the fact that I am an LLC (Member) not an owner. I kept thinking about, "who in the world writes my employee letter?"

Thus, the I-134 requests a letter from "the employer" --- well that's ME and I am also the Employee! So, NVC said all you have to do is have your "Lawyer (no have), or your Accountant" write a letter to verify that you are LLC Member of this company, Estimated Gross income for 2011, send in the EIN# receipt from the IRS, and copy of my License at my current address. I have payroll checkstubs but I don't get paid on exact dates, such as one working for a big company would, ie., every two weeks. So Thank God for my accountant and the lady at the NVC who could answer this. Also for the I-134 my 2010 tax filing plus the 1099's (in my case). I'll use the same information regarding my LLC for my i-864 with 3 yrs tax returns when we adjust K's status.

We sure have to do a lot of admin work 'to marry a foreign national' don't we? Sheesh! <hands on hula hips>
