Dear all,

USCIS don't care about pictures. They said the pics are secondary evidence and they have to be film dated not HAND dated. They also said in the RFE that emails, chats, phone bills, bills...are irrelevant and unacceptable. They also said Flight itineraries and undated boarding passes are not acceptable. Finally, they said please submit copies of passport pages showing name and stamped entries to the beneficiary's country. I suppose dated boarding passes are acceptable. This is extremely important as I didn't know this stuff when I first submitted and got a RFE. I don't think anybody should get RFE for something like this. So guys, listen, I told you this exactly from my RFE paper. Hope my RFE becomes NOA2 now.

I didn't know that either, thank you for sharing. I was so concerned with emails, chats, pictures, itineraries, etc. when I filed. I didn't put the pages of my passport in, but I didn't see in any instructions anywhere to do that...unless I missed it which is very possible...:unsure: I did put copies of my boarding passes. We got our RFE last week, an extensive one, and we are working on it. I hope and pray it turns into the NOA2. And best wishes for you, I hope you get the approval. Good luck:)

I've never heard of anyone having issues with hand dated pics.. mainly because it's so easy to manipulate the digital date on the pics it's kinda silly to digitally put it there anyway, either way yes, photos are secondary evidence.

Flight itineraries are fine if send in conjuction with DATED boarding passes (showing you actually check in), and the stamp from your passport shows that you landed in the US. I'm sure there are threads about this somewhere because it's constantly talked about.

I'm sorry you got the RFE but proof of meeting means you need to prove WHEN you met. Sending undated boarding passes, hand-dated pics, and that's all is worthless. Chat logs etc aren't required until interview because all they need NOW is proof that you met in the last two years. You need to think like someone who isn't you. Show it to a friend, does this prove we met in the last 2 years? Pics? No. Undated passes? No. Dated passes? No. just proves you checked in. Passport stamp? Proves you landed in US. Put passport stamp, boarding passes and pics together and it's closer to proof you've met in person.

We sent boarding passes (x 6), 4 photos, flight itinerary and stamp from my passport (plus biographic page). no problems.

They are asking for (highlighted above) bcoz they are trying to find the proof that you have met within 2 years. About pictures, they dont really focus their attention to that bcoz in modern ways now you can make a picture of you together without seeing each other in reality. I really hope you'll receive your NOA2 soon! Hang on there, it's coming your way! :thumbs:

Well we filed the CR1 not the K1 but I looked at both guides and they say "Copy of the full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship". That's what I went by...I put my birth certificate in the file but not the passport.

But your post has really made me think...my birth certificate has a seal on the back, no color, is very hard to see unless feeling for it. Also, you sent your ORIGINAL birth certificate? I hope you have started the process to get a new one, you won't be getting that one back.

**Edit - you're talking proof of citizenship, the OP is talking about proof of having met. The OP sent copies of the passport pages showing his passport stamps. Also proves citizenship (as long as the bio page is included) but the OP didn't tell us if he also sent a COPY of his birth cert

I was just stating that the guides say to send a birth certificate or all copies of the pages of the passport....and I don't know if he sent his birth certificate or not...I was just thinking out loud.

Just an idea, but they may be looking at the date printed on the back of the photos by the lab.

Now...that wouldn't be smart since you can just get negatives reprocessed!

I will focus on receipts, boarding passes and VISA stamps! I want to file on Friday. ^^

I've never heard of anyone having issues with hand dated pics.. mainly because it's so easy to manipulate the digital date on the pics it's kinda silly to digitally put it there anyway, either way yes, photos are secondary evidence.

a high resolution full color copy would have.we have very delicate stamps in our birth certificates,and while it wasnt necessary i did add copies of his and my passport,all pages,with my birth certificate.we used a high resolution black and white copy,the stamps still showed

Film-dated photos are NOT required, and, in fact, no better than hand-dated photos. As someone said earlier, it is trivial to overlay an incorrect date on a photo. Please post a scanned image of your RFE.

"Film dated photographs" do not come from a digital camera.

You, and commonly others, have confused two separate issues. The instant context here is evidence of meeting in person within two years. For that purpose, photographs that are not film dated, flight itineraries and communication evidence are worthless. All boarding passes are dated. USCIS accepts copies of boarding passes as evidence of meeting in person if the flight landed or took off from the country of residence of either the beneficiary or petitioner. Common sense would tell you that passport stamps are better evidence but in many cases, the stamps don't actually appear on a page that also contains the name of the traveler.

Evidence of the relationship is not mentioned by USCIS at the petition stage because they aren't asking for any in a fiancee case. People include it so the Consular officer is likely to see it prior to the interview. It's a tactic, not a requirement.

Thank you for sharing with us, but what did you send in your original submission? I think it has been said, many, many times on the forum's posts that petitioners should focus on primary evidence and we always recommend sending copies of passports showing the country stamps. Aside from that, boarding passes are good evidence (I have yet to see a boarding pass with no date!). As for the rest (pictures, e-mails, chat logs, phone calls, etc.) we have also said that it is secondary evidence and does not help establish the main purpose (meeting in person within the last two years), but perhaps nice to have -particularly in difficult, high-fraud countries. I hope your RFE is accepted quickly and your petition is approved.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
