Hi,

Im not sure if this is the best place to post this but I am new to these forums so forgive me if its in the wrong place.

I am currently in a relationship with an American, I personally am Australian. I am curious as to wether I can legally marry him In the US on a visitors visa

I have no intention of staying and I do not currently wish to immigrate, My only wish is to be married to the man that I love and want to spend the rest of my

life with. Will I be causing myself more trouble if I do marry him on a visitors visa and return home in accordance with the Visa I will have, or is this a common thing?? I really can not find any accurate information on the subject, and it seems that everyone will assume I am trying to evade the laws and immigration process. It is not my intention I just wish to marry my partner and I am not currently able to immigrate anyways. Any light you can shed on the matter will be greatly appreciated.

Thank you in advance.

Yes, you can get married on a visitor visa and return home in accordance with the terms of your visa. Happy wedding!!

Hi there and congratulations!

Once you return home, the USC can file for a CR1, which is a visa to bring over your spouse. Check out the guides above and they will pretty much lead you through the process. The only consequences would be if you overstayed your visitor visa, or married with the intention of adjusting status status while staying here. Marrying and going back home to file for immigration, is perfectly legal and fine.

Yes you can legally do this, sometimes at the border people run into issues with this when they run through the quiz with the CBP officer. The reason for this is the assumption that everyone who comes here is an intending immigrant, and there is an established procedure for coming to the US to marry the fiance, which is not the tourist VISA. So if they ask you the purpose of your visit for example and you say to visit Disneyland and then they open your suitcase and find the wedding gown.. its a problem. Your best strategy to avoid issues is be honest with CBP when asked, be prepared to be turned around at the POE if you run into a cranky agent, and have all proof of ties to your home country with you so you can prove your intention to return after the wedding.

There will be no consequences?? also do you know anything about the process can we simply marry as he would to another citizen?? or are there special requirements? Thank you so much for answering you have given me a tiny piece of mind in a very crazy situation :)

Absolutely no problem marrying your fiance and returning to Aus... you MIGHT encounter a problem entering the US (unless you're here already) so you will need to show strong ties to Australia. Once you marry him your "immigrant intent" meter jumps up a lot. So any attempts to visit your husband (after you get married and try and visit again) may require strong evidence that you don't intend to immigrate...

Marriage requirements depend on your state. In Iowa I only needed to show my passport. Some states SAY they need a SSN on their website (like Iowa did) but in person it's not a problem.

Congratulations on your up-coming wedding!

You wont need a visa,,,you can enter the US under the VWP, but DO NOT mnention to Immigration that you are here to get married.

--- OR---

You can apply for a visa, under the premise that you are going to the US specifically to get married. The Consulate would need evidence and nned to return to Austrailia.

______

Fly to Las Vegas, take cab to marriage license clerk adjacent to the Clark Couty Courthouse, pay $55 for the licence, walk down street to nearest wedding chapel and get married.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Many people get married in the US with no immigrant intent.

Quite popular in Las Vegas.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Just check up on the marriage requirements in the state you will be getting married in. For example, you might need to bring your birth certificate with you :-)
