Hello,

I was going over all the sample questions for the K-1 interview and came across one question that scared us, it was " where do your parents live?" it scared us because my fiances parents are illegal in the states, and we dont want to get them in trouble. My question is, If he tells the truth, like we plan to, will they look into it and deport his parents or can they not do that?

On the DS-230, question 16 and 18 you had to put the name and address of the beneficiary's parents, what did you put? Please don't tell me you lied and put they were still in Mexico?

Here are your choices:

1. Put Mexico and then YOU have lied and run the risk of material misrepresentation some time down the line

2. Put US and whatever happens, happens.

They might look into it. I've never heard of it happening but I would be lying to you if I said they were fine. Also, it might be they get caught a month after you submit your paperwork, having NOTHING to do with you, just a coincidence... are you gunna feel guilty anyway? USCIS doesn't ask for a street address, they ask for a place so just be honest and write "USA".

His parents are adults. They run their own lives. Whatever happens isn't due to YOUR actions, just remember that. You didn't force them to live here illegally and there is nothing wrong with making sure your new little family (you and your fiance) is safe and protected by ensuring you always tell the truth.

The situation is really begging the question: Since your fiance's parents are in the US ilegally, then has your fiance lived ilegally in the US? This could also change things for you (in terms of getting a denial).

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I just wanted to know others experiences with bring a fiance with the K-1 from mexico, I can read the process times and all but i wont get a sense of how it is unless i ask someone with experience.

Heres mine,

My fiance is a illegal citizen caused by his mother bring him here as an infant, not by choice, i met him in high school so he was under 18 when he decided to do something about it. We filed july 22 2010 before his 18th birthday, they received it on july 23, and we got the receipt that the office received it Aug 3. Since he is already 18 he is leaving the states at the end of october. We do have a daughter together so i am hoping this goes by fast and he is safe in mexico.

My questions are how long from the time you received the receipt to the appointment date, from appointment date to receiving a O.K. to flight back did it take? What happens at the appointment?

If he was here ilegally, by definition, he was unlawful. If he is now back in Mexico on his own will and doing, then he has actually self-deported and may have activated a ban from this country. This situation is complicated enough to hire an expert immigration lawyer because these issues will raise red flags that will either deny your petition at the USCIS stage, or deny you at visa interview time. Check out the regional forums to see if other people who have filed for Mexican beneficiaries have had a success story even with a situation similar to yours. Still, an expert immigration lawyer would know the law and any potential loop holes better than any member here.

@Op, just because you've file a I-129f Petition that doesn't stop him from adding days of unlawful presence. Also there is no such thing as an "illegal citizen" he is currently an Illegal Alien/Immigrant...
