I have no idea Besa. I have had no formal decision or written notification to tell me that my case has been denied. The only reason I know is because the online status says so!

Just going to let you all know that I am not going to post here until I receive this denial letter in the post. Its too hard to come on here and read everyones interview or EAD stories. Hopefully I will be back on soon to let you all know what happened. Good luck to you all (F)

The plot thickens.

I have just checked the mail to find a USCIS envelope addressed to my hubby. I open it and it's an Approval Notice for the I-130!!!!

The letter says;

"The above petition has been approved. The petition indicates that the person for whom you are petitioning for is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain Form I-485 Application for Permanent Residence. A copy of this notice should be submitted with the application.

If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file Form I-824......................and so on".

What the hell is going on now?! This ####### up is obviously because we submitted the I-130 petition a month before the AOS forms. Why would my petition be approved but the AOS is denied? Why does this also happen to me at a weekend when I cannot contact USCIS?! They must, surely, be aware that I have submitted my I-485, I-765 and have had a biometric appt? Maybe not. Where do they get those guys that work in the service centres? Does a "special" bus pull into the Missouri service centre every morning and drop off the people that work there?

Umm wow... I wanna say congrats but ya need to talk to someone at USCIS... I personally dont think that if you have an approved I-130 that ya gotta do a new I-485 & I-130. I could be wrong, but you wait for the letter to see what it says and hope they allow u to just submit the I-485 & I-864 again. Wishin u all the best love... Happy belated

Sounds like they adjudicated the I-485 before the I-130. Maybe the I-485 isn't denied after all. Maybe it was just sitting in limbo waiting for a decision on the I-130.

Hey, I was reading an March filer that seems to have the same situation as you.

Here is the link. The I-130 was approved and her I-485 was rejected because they filed too early, may be that's why your AOS was denied.

the member name is: nekomyu

nekomyu's case and mine are (I believe) different, ours spouses are LPR (legal permanent resident) so we have to have an I-130 approved first and that's not all. Our priority date should be current for F2A category in the Visa Bulletin. Then you apply for I-485. They actually did not accept the I-485 from the begining for nekomyu and did not cash checks, they returned the application because she filed 3 weeks earlier than March 1 (when the priority date would become current).

If the spouse was USC then you can file all of them together! Or you can file I-130 first, then attach a copy of the NOA of I-130 to each of the applications (I-485, I-765 & I-131). The best to not confuse USCIS officer is to sent everything together!

Yeah, I think your issue was you didn't have an approved I-130 when you sent the AOS package in. Either you have to send the I-130 application in with it, or a copy of the I-130 approval, I believe (if I interpreted this correctly):

An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

There is still no sign of the denial letter yet. Phoned USCIS again the other day (I don't know why I am wasting my time doing that though!) and as usual the young girl on the other end of the phone was as dumb as the rest of them :bonk: She did say the usual speil ...oh you have to wait your 45 days to receive the letter bla bla bla - whatever :no:

Try to contact the USCIS ombudsman. In a situation like yours, they can directly deal with the people who adjudicated the applications.

Well I have waited too long and we have decided to give up on it. I have booked my flight back to the UK for September. My husband is coming with me (under the 6 mth vwp). Even if all this was a mistake and I haven't been denied and I do eventually get an interview then at least I might still be able to do that before flying home. What a waste of money this has been. I was going to contact our local congress person but there is no point now. My husband and I both want to get out of Alaska and at least I can go home now and get a job!! Once I have a job back home we can them start my husbands UK visa application. I know I probably wont be able to come back into the US, but I really don't care. Well I have waited too long and we have decided to give up on it. I have booked my flight back to the UK for September. My husband is coming with me (under the 6 mth vwp). Even if all this was a mistake and I haven't been denied and I do eventually get an interview then at least I might still be able to do that before flying home. What a waste of money this has been. I was going to contact our local congress person but there is no point now. My husband and I both want to get out of Alaska and at least I can go home now and get a job!! Once I have a job back home we can them start my husbands UK visa application. I know I probably wont be able to come back into the US, but I really don't care. I will keep updating this thread until I leave. Good luck to you all and thanks for all your help and advice (F)
