We have also booked my hubby's flights to Scotland too (unfortunately a return one as he will have to apply for his visa within the USA). I still haven't received any God damn denial letter from the schmucks (that word is soooo American...I love it!) at the USCIS.

Well well well....

My denial letter was in the mail today after all. The date on the letter was changed from 1st June to the 16th July (obviously because I never received the original letter). The denial was to do with the evidence I sent back. They said that I only partially sent back what they had requested for. I sent back all that I possibly could. Never mind it's over now. The only problem I have now it that they have said I have 30 days to leave the country or they will start removal procedings against me. My flight back to the UK is boked for September, which means I will be here longer than the 30 days :unsure: I have no idea what to do. I am not losing my money that I paid for my flight home. Do I take a chance and stay here until then? I wonder how long removal procedings would take?

may i know the reason why you are denied? like which part of files are you missing? I know you sent all that you can sent. but what are they requested?

I just now saw that you started this thread. I fully understand your decision to move back home. The UK process should be a lot easier, my Russian friends got a 3 year work permit in a few months without having jobs and any requirements for sponsoring etc. I had a similar experience with my H1B visa, the petition (the employer) was approved but my adjustment of status was denied. This is a weird process, just feels like they can't use logic at all. Anyway, I stayed since I was already out of status but then again I never got that scary message about removal proceedings. So I don't know how long that would take. Good luck to you in the future!

I would leave before the 30days. You can change your flight for about 50-150.00. So sorry about your situation.

You could try contacting the local USCIS office and show them that you had booked your flight already for September even before receiving the denial letter and ask them if they would extend the time you can stay until the date of the flight. If they say no, then you need to change the flight, but at least you can ask. Good luck.

This is my last post on here.

I am going to take a chance and stay until my flight in Sept. It's only another 30 days after the initial 30 day period. Surely if I have booked a flight on my own accord there won't be a problem. I can't go to a local USCIS office as the nearest one is 7 hours away in Anchorage. I do not have a lawyer and we are not going to get one. I do not care if I cannot get into this country again as I only wanted to be here because this is where my husband lives. I am sure we will have a happier life back home in Scotland.

For info, the denial letter stated the following;

"There is no appeal to this decision. However, if you are placed in removal proceedings, you may be able to renew this application in such proceedings before an Immigration judge. Furthermore, this decision is without prejudice to future applications filed with the appropriate USCIS office.

USCIS is not initiating removal procedures against you at this time. The decision, resulting in the denial of Form I-485, leaves you without lawful immigration status and you are now present in the United States in violation of law. You are required to depart the United States with thirty (30) days from the date of this decision, or be subject to removal proceedings. Remaining in the United States beyond this time will affect your ability to return to the United States."

Surely they will not start removal proceedings in the 4 weeks between the end of the 30 day period and the day my flight leaves??
