I asked the person on the 1-800 number if I needed an INFOPASS and she said it wouldn't be worth my time!!! :bonk:

If I arrange an INFOPASS and I speak to the same IO that I spoke to on the phone yesterday in the Anchorage office, then I may as well not bother, she wasn't any help at all either. She said that because these letters come from the service centres she doesn't know why I was denied or anything!!! ###### useless the lot of them :bonk:

I originally posted this on the April filers thread but have been advised to post this seperately to see if this has happened to anyone else.

As you can see from my timeline in my signature I have had 2 RFEs - 1 for my I-130 and another for I-485 (I-864). I sent back my RFEs within the timescales and all documents have been received at USCIS. I eventually recieved my biometric appt letter which was dated 1st June. I attended my biometric appt on the 16th June as requested.

I check my online status on the USCIS website daily. The last time, before yesterday, that my status for my I-485 was updated was the 19th May (the day they received the RFE). This morning I went online to check my status to see if it had been updated after my biometrics only to find the following messages;

On June 1, 2010, we mailed you a denial decision notice for this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. The notice explains why the denial decision was made and the options that may be available to you. I was taken back by this and was very upset and stressed. It does not make sense at all. First thing, I have not received any denial letter in the post. Secondly, my online status was only updated yesterday but it was dated 1st June. Finally, if a denial letter was sent on the 1st June, why was my biometric letter (also dated 1st June) sent to me as well?? It does not make sense. If my case was denied why would they bother sending a biometric appointment?? The mail is slow in this country but it does not take 18 days for a letter to get to me up here - it usually only takes 2-3 days for me to receive any mail from the USCIS.

Since it is the weekend I cannot contact anyone until Monday to find out what is going on. Fellow VJers on the April filers thread have suggested contacting a lawyer, making an INFOPASS, contacting my local congressman and so on. I am hoping that someone out there can give me some advice, or have been on the end of something like this before. I think a mistake has been made on their computer system. Others on the April filers thread say it probably isn't a mistake. Again, I do not see why they would schedule my biometric appt when they knew my case was supposed to be denied??

This does not make sense what so ever. I am hoping that it is a mistake. This is my life they are messing with.

It is not a mistake. It does not take that long to mail something but it can take that long just to get in the mail.

My guess is that something in your RFE response was not adquate, the letter will tell you exactly. You get ONE RFE and ONE chance to respond. If the response is not adquate, in THEIR opinion, you get denied. Don't take it personal, it is just procedure.

You have two choices. File an I-290 within 30 days to re-open the case ($585) and state the reason the case should be re-opened. You must give new evidence.

OR

File a new I-130/I-485 within 30 days. $1010 plus the I-130 fee of $355. The problem with the cheap route is that they can deny re-opening the case and you are out the $585. Then you have to re-file the I-130/I-485 anyway. If it was an inadequate RFE response, they WILL deny your request to re-open. The only way they will re-open is if THEY made an error or their was some reason you didn't need to respond to the RFE that evidence now exists for that did not exist at the time of the RFE.

The denial letter will be all scarey and tell you that you have to leave the US within 30 days. Just file one of the above and go on with life. Find out where you made the error and correct it. Pay the fees and get on with it. DO NOT leave the US while this is pending and until you get your green card, you will have no way to re-enter.

Yes, they are. No one on the phone will tell you anything. No one at an infopass appointment will tell you anything. The letter will.

I have explained what you will need to do, I have been involved with many such cases and it is usually not a big deal, but it is expensive. Get out your check book. You will file to re-open or file a new case, pay the fees, correct the errors and GO. Phone calls will do you no good.

Thanks for your response Gary and Alla. The problem I have now though is if I have been denied from the 1st June and I do have 30 days to leave the USA, then that means I have to leave by the 30th June!!!! The denial letter was dated 1st June (as per online status screen). The idiots at USCIS told me I had to wait up to 45 days to receive the letter. Doing that means I am breaking their rules once again. That doesn't make sense either.

We have decided that if I am denied then I am going back to Scotland and will start my husband's visa for the UK asap. If they don't want me in this country, even though I am just a normal joe who has no criminal past and has married a USC and wants to have a happy life together, then I do not want to be here either.

I am at a loss of words, i hope you get through this!

But just like someone else mentioned earlier, you do not have to leave the country - the rejection letter may be scary and all but you don't have to leave. If you decide to go to scotland, you still want to be able to come to the US when you want and leaving wiht a denied case may make that impossible. The denial of your application it probably has to do with the first RFE you got. If i read your response correctly, your income qualificaiton was based on your husband's projected income for 2010 which may not have been okay with them.

I will advise you to do the entire process again, but this time get a sponsor to jointly file the I-864 for you. It will most likely end up being your cheapest option at the end of the say. My friend has a similar experience, he applied again and covered all the holes of the first appliation he filled out and got approved at the interview. Don't loose hope and don't just leave the country because it may be almost impossible to come back.

I agree. I wouldn't leave a country on your place. Having a denied case behind you will give you problems.

Don't think that there are a particular person sitting and saying that they don't want you in this country. You deserve to be here with your husband. Dang them all.

Please don't wait!!! Nobody will come to you and say what you have to do in this situation.

The best you can do is to get your husband in one hand,papers in another and SEE A LAWYER!!!

We don't have thousands of $$$ available to us just now to afford a lawyer. We are stuck.

I could go home, get a job, sponsor my husband for UK visa, and we live back home. I think that is a lot more easier to do than the hassle we have just went through/going through.

Once I leave here I have no reason to come back to the US. My husband would follow me over once/if his visa is processed. If he is unsucessful then we go and live in the country in which he was born (he gained USC through naturalisation).

I have just phoned the 1-800 number again and actually spoke to an agent who has a brain :wow: He has put in a request to the service centre for them to send out another copy of the "denial" letter. So much for the; "oh you will have to wait up to 45 days for the letter to come to you bla bla bla"

Thanks :thumbs: It is very nerve wracking and I can't think about anything apart from DENIAL DENIAL DENIAL. I won't let it spoil my weekend or birthday though :dance:

Happy Birthday to you! (F) I hope things will speed up and you will get that letter. At least you will see clearly, black and white, the reason of denial. If I were you I would go for the infopass, the waiting would drive me crazy!Good luck!
