Community SpotlightDV Lottery of K1 Visa - Can I file for both?
Petrisaint Mpaka posted a topic in K-1 Fiance(e) Visa Process & Procedures,
I applied for the DV lottery 2025 and hope to be selected this year. My fiancé and I discovered that there is a fiancé visa for the USA. Do you think if we apply for the K1 visa but are selected for the DV lottery that we can stop the fiancé visa process? What are the timelines and options here :)?-

Confused about steps after marriage
SP1988 posted a topic in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas,
My fiancee arrived last month on K1 fiance visa and we got married yesterday. It seems from what I have seen online that I made a mistake by not getting SSN prior to marriage? I am going to the SSN office on Monday to gather more information... also worried about employment authorization and travel authorization(s). Thanks for any insights!-

Tourist visa cancelled by CBP agent. Can we still get a CR1 or K1 Visa?
yotajeeper posted a topic in What Visa Do I Need - Family Based Immigration,
Upon my gf's most recent arrival, her tourist visa was cancelled at the airport due to her frequent visits last year and suspicion of working here. She was denied entry and sent back same day. Is a CR1 or K1 visa process an option still? I would appreciate any advice or tips you can provide!-

Recent Immigration DiscussionsNeed advice: Is it possible to withdraw a K1 and go for AOS? 11:28 am today

8 RepliesHi everyone,
I'm Justin from The Netherlands, currently in the US on a ESTA (VWP) to visit my girlfriend. We just filed for the K-1 Fiance visa on April 1st and got our confirmation back about a week ago that it has been received by the USCIS. After dating for 1,5 year and going through many challenges with traveling back and forth, we decided we really want to marry asap now while I'm on this trip. We teamed up with Boundless (a lawyer-support program). They advised us to go for the K1 visa since the processing time is only 6 months. After filing for the K1 we suddenly got updates that there's been a run on K1 visas and the processing time has gone back to a minimum of 15-19 months. Since we are Christians, it's starting to become really difficult to wait any longer after already 1.5 years of waiting. Therefore, we got kinda freaked out by the fact that it could take another 1.5 years and then after that we still need to plan a wedding, etc. So we are currently considering changing our whole plan and going for AOS, but it seems difficult to find good information about the possibilities of AOS. Some say you have to overstay, get married and then file AOS. Others say you have to do it in your 90 days of your tourist visa. On this trip, I came in on the intention of just visiting my girlfriend and to get engaged by the end of the trip (I'll ask her next week :)), and just enjoying our time together here in the US. While we're here we decided to take this to the next step, so I don't think it's visa fraud? Can someone please help me and advice how to go forward with this? Is it an option to withdraw a K1 visa, overstay on the ESTA, plan a wedding for in the summer and apply for AOS right after? What are the risks? My dad in Holland is getting older and I do need to be able to travel back once I have my travel permit/green card. I could easily wait for about a year and a half without traveling, that's no problem for me. Me and my girlfriend just want to be together and get married now.
Another good thing to know is that we can't marry and stay in Holland, my country, since you have to be 21 to be able to live in a Holland as a foreign outside of Europe fiance(e). So we are kinda left with no choice. We have to live here. Also good to know is that we're at the end of my 3 month trip. On May 15 I have a return flight to Holland and my esta expires in June. So I have to make final decisions really soon.
Can someone please advice me since I'm so stressed and have terrible anxiety about how to go forward? Is there a risk they won't approve the AOS since I'll overstay for example? And does that mean I will get deported or will never be able to travel back to Europe again?
Thanks so much for your help everyone. Appreciate it!

2 RepliesHi everyone! So I am the beneficiary and I live in Metro Manila
We got the K1-FTP 2 weeks ago and CEAC says "READY" 5 days ago.
I tried emailing them and talking to a person via chat support. The person said just wait and it looked like she does not know when I will be receiving packet 3 or an email.
So I don't know if I should wait for packet 3/instructions for me to proceed with booking my interview and medical.
I don't want to waste time but I am scared, I tried to book online but I read before proceeding that If I don't have any instructions yet do not proceed etc2.
Should I call them or wait? What exactly do I need to do next?

2 RepliesI filed for N400 March 1st 2024 out of NYC. I also applied for ROC in November 2022; there is no movement on either except the generic biometric notice for N400 and the obvious extensions on green cards. Is this normal?
Previous B2 Visa Denial. Tips for Re-applying? 10:40 am today

3 RepliesHi! My husband recently became a U.S Citizen on 4/3/24, after having a 2 year conditional green card. He would like his parents to come visit us in the U.S, but we would like to know what we should do differently for the second B2 application. The first time his parents applied was in March 2023 and they were denied under section 214(b).
For reference, his parents reside in Trinidad and Tobago and my husband is their only child who now lives in the U.S. His dad has been working for the same company for the past 15 years and his mom has been working for the same employer for the past 10 years. They both own one vehicle, which is under his mom's name (only one owner is allowed to be on a vehicle ownership in their country). Also, they have their own house but the land it sits on is owned by his dad's parents, so they don't have a property deed with their names on it. However, they do have utility bills but they are only under his dad's name (only one person can be listed in their country). Lastly, they do not have any outstanding loans and they've never traveled outside the country.
The first application they submitted in 2023, they provided all the proof I mentioned above and with that they were still denied. The officer asked if they own a home and how many children they have. Once they answered that they have one child, they were immediately denied.
We would like to try applying for the B2 visa again soon, with proof of a registered business that they've had for years but didn't register until recently. Also, his mom is now the caretaker for both her parents while still maintaining her normal M-F job. What other proof should we add to their applications? Also, do the chances of approval increase if we decide to apply for one parent then the second parent next year, rather than applying for both at the same time?
My mom is going to be a joint sponsor for my husband, would I also put her as a household member? 8:51 am today

4 RepliesHey everyone!
My husband, who lives abroad, got approved for the I-130. we're now at the NVC stage and since I make less than the poverty line, my mom will be my joint sponsor.
Our current situation is this: I live with my mom, along with my brother, both him and I are not dependent. My husband and I have no children and he will be joining me at my moms house (once we finish the immigration process).
My question is this: would my mom, as the joint sponsor, be filling a separate I-864? or I-864A? Since we live together, I wasn't sure what would be the right procedure, and what each of us (my mom and I) should put under household members.
From reading other forum posts with different cases, it seems that the prevailing opinion is that it's better to file a separate I864 rather then trying to combine income with household members, but I wanted to make sure.
Also, I wanted to make sure I was filling the I-864 household size section correctly, I'm assuming if my mom and I file separate I864's, we would each have a household size of 2? Ourselves and my husband? (as I stated before, my mom has no dependent children)
Thanks everyone!
