About to propose. Need to know the VISA Process

New to this forum. A little intimidated by the wealth of knowledge on this website. So i wanted to just post and ask and get pointed at the right resources. 

 

 

I am a US citizen and gf is an indian citizen but living in Canada with as a Permanent Resident. We met online and i visit her quite often.

I will propose soon but i need to know about the Fiance Visa process. Since she is Indian citizen, should i apply for a fiance visa in India or in Canada since she is living as PR?

Can anyone please also explain the process to me and about how long can it take?

I think that she will be processed at the embassy or consulate in the country where she lives. 

 

Also, have you looked into doing the CR1 visa.  Apparently with a K1 (fiancee visa) she wont be able to work, travel, get a drivers license for quite a while after she moves to the US.  Since you can visit her now, why not do the CR1 and she can continue to work and you can visit her.  They say its cheaper and only takes a few months more.

She can continue the process in Canada as she has residency. However as mentioned above looking into spousal visa may be a better choice.

Apply for k3 the spousal Visa. K1 is horrible. We are waiting as long as k3 without the benefits of k3. If you're going to wait might as well do it with k3.

Hi thanks for your replies. But spousal means that we have to be married already correct? Which means we we'll have to get married in canada? We want to be married in the US because thats's where my family resides and we want it to be a family affair and all.

If she can legally visit the US, you can get married here (quick checking says Indian citizens need a visa to visit the US; I don't know how difficult it is for her to get one or if she already has one), but she'd need to go back to Canada afterwards.

If not, you can marry anywhere else that will let you (it doesn't have to be Canada or India).

It is the CR-1 visa not the K3. The K3's are essentially dead at this point in time and as of last year only about 100 were issued world wide. What usually ends up happening is the K3 is reverted to a CR-1 process and visa.

You can always have a reception in the US later.
