My fiancé is Nigerian and would like to take classes here.  We cannot get the K-1 visa, because my divorce is not final.  It looks like the only avenue for him to come here would be by applying for college.  Do I apply for the visa or does he?

He would have to apply to the univeristy or colleges and do most of the dealing himself.    But this sounds like more of you trying to bypass the visa process because of your divorce.

Part of education visas is showing that they have intent to go home and use their expertise.  He'd be hard pressed with an American fiancé.

But this sounds like more of you trying to bypass the visa process because of your divorce.

 

Just wait til the divorce is final then petition him.

He would have to qualify for, and apply for a student visa on his own merits. With a USC fiancé, and being from a high-fraud country, that will be very challenging. Also, be aware that he is not allowed to enter on a student visa with the intention to remain in the US permanently. 

If it isn't difficult, it isn't worth it.

 

K1 process

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

But with having the idea or want to do a K-1 already shows other intents. So you shouldn't try to get another visa in the others ones place.

I guess I should have not worded the original message that we cannot get the K-1, but that we would not be eligible for that particular visa.  We hadn't applied for it.  Also, with the education visa and me being a fiancée, would it make a difference that I am buying a house in Nigeria?  Especially as far as him showing that he plans to return there.

obviously not cheap but if he has the money and can show a logical case go for it.

the form for applying for the student visa asks if you have any family members (including spouse and fiancé) in the US, just FYI

I could write a book on the misinformation posted on that site, not sure why it comes up removed, maybe one reason.
