Timeline

Finally my wife kick me out of the apartment in the middle of ROC just 60 days and she holds on to all my document,include my 1yr extension GC and my passport,all the copy of our joint ROC.Just me and my little car sleeping on the parking lot.she told me she is going to call the immigration to withdraw the ROC and deport me to my country.what should i do?where do start from after 4 to 5yrs marriage.

Start by call ig the police and getting your documentation back. Tell the police she is refusing to give you your documents after you have agreed to leave the premises. If you are married to her she can not evict you without a 30 day court order notice. She can send a letter to withdraw your status however she can not deny you of gathering your documentation. My advice is figure out why she is being this way if she doesn't want to give you a reason take her to court divorce her you have rights and call the office and ask for advice on what you should do as far as ur status.

Go to the police station in the town you live in and tell them what happened. Legally, your wife does not have the right to kick you out the house because it's your legal address and you both have the right to live there, she also does not have the right to withhold any of your documents or belongings in general. Don't be afraid, go to the cops if she refuses to cooperate with you.

The immigration process caused me PTSD.

Call the police. She cannot legally keep your property and the documents she kept. She can not force you to leave, you need to agree to leave without a court order.

Also get a lawyer asap. A divorce lawyer familiar with immigration issues. She cannot get you deported or withdraw your ROC. The ROC application is your application and they won't even talk to her about the status of it without you giving permission to them to talk to her. No matter what she attempts to tell USCIS, they'll pretty much ignore it unless she has hard evidence fraud was committed.

And looks like you ignored it..

You can file a police report against her..but remember, it is your word against hers. The police will need a reason cause to to even search her home for your document or to arrest her. You can try civil approach or you can try the law but you have given her the upper hand already..

As others have said go to the police to report that she has all your documents.

They will tell you what step to take to get them back.

You can divorce and file for ROC with a divorce waiver, you don't need her, it's your application.

If filed jointly then it would matter but with a divorce waiver you are ok as long as you can prove you entered the marriage

You need a good immigration lawyer to guide you if you are lost in this process.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

First Go to your local police department. You cannot call since you are not in the middle of ultercation. File a police report and complaint about your documents and see if an officer can have you remove your possessions. If she destroys them she Can be held accountable.

Second she cannot evict you from your home with out notice and a court judgement. You can choose to find other lodging hence not deal with her drama.

Finally!! As an immigrant in this country woman or idiots in general will try to mess with you so never ever give anyone access to any of your documents. Get a lock box there 20-30 at Walmart and they are fire proof. Lock it and worse case when you arrive with the police you can remove your box with document intact.

And the ROC situation the woman is not that knowledgeable of immigration proceeding this is good for you :thumbs:

She cannot send a letter to withdraw his status nor can she have him deported. She cannot do much of anything at this point regarding his immigration status except what she's doing now (withholding his papers) which is illegal. He can file for ROC on his own with a divorce waiver.

Op, I agree about calling the police and getting your documents back. Then go ahead and get your divorce. After that you file for ROC on your own with a divorce waiver.

Go to the police department and request a police escort to retrieve your belongings this is not just her home but yours too so no warrant or reasonable cause is needed. They will escort you in and supervise while you get your things together after that file divorce asap.

You live in Broward county? Go to the courthouse and speak to someone in the self help section of the family court they should be able to give you information on free or low cost legal services or options to help with filing fees. If you need more help with this part PM me Im a paralegal I can help lead you in the right direction, family law I have a lot of experience with the immigration part of it and ROC I dont though.

Like someone told me years ago after major difficulties dealing with drama (now my long ago ex), they bluntly said "Pick better next time". I think I have so now I just need to "treat kindly".

Call the police and get your documents back!!! NO ONE can hold your personal documents. Get them back before she destroys them and then you have nothing!!

By the way it is very very very hard to get someone deported. Especially if they have legal status. She better have good concrete evidence that something wrong was done. Not just a little evidence MOUNDS of it. Good luck!! Sorry about all this!
