Timeline

After 5-1/2 months of waiting we have been denied. I don't know what it could be, just have to wait to get the hardcopy to know the reason. Our love is strong, this is just a bump in the road and I'm prepared to fight for my baby.

It was a single RFE. They asked for my fiancee's divorce certificate. Originally we had sent notary papers of divorce and certificate of no marriage. In response to the RFE we sent the proper divorce certificate in Chinese and a professional translation. To the best of my knowledge it was done as they asked.

Sorry to hear that. I see that you used an attorney...are you sure he/she responded to the RFE appropriately?

I have a copy of what she sent. It looked perfect to me. We will see if that is the reason, hopefully I get the hard copy of the decision this week.

Ok yes sorry I can see it now. I thought first it was several so I thought the main problem was they were asking for something that wasn't provided.

I hope the denial has nothing to do about the original signatures in the letter of Intent and the G-325 form from the beneficiary.

Jan/30/2019 -- Case Approved. New card is being produced (DHS- USCIS website & USCIS tracker)     

Feb/04/2019 --  Received  letter with Approval notice 1-797 (notice date Jan 30/2019).

Wow, I am speechless. Very rare to hear a denial at petition stage unless something very bad like Adam Walsh Act or improperly responded to RFE. Stay strong and keep us posted a reason of the denial. Some people here might shed some light for both of you. Sorry to hear that.

Appeal is just wasted of money and time. And even so he could try, the OP should know why the petition got denied at first place otherwise he will stuck in limbo.

The one RFE I got was in regards to my fiancées divorce certificate. I really believe that it something as simple as an inexperienced adjucator reading my fiancées Chinese divorce booklet and not feeling it was sufficient. The wording in those books is not as verbose as what we see here in the U.S. The booklets just list both person's names, a divorce date and say it is an official book. I just hope we don't have to start all over again and go back to the TSC.
